You are completing the project that was started in module 07. Here is the course project schedule you followed:

Your final course project deliverable due this week is a Microsoft PowerPoint presentation. You will summarize what you learned about applying software for law office uses in this presentation. You will prepare at least ten slides, with at least one comment on each part of the project, from the list above. The ten slides should include at least five quotes from the text. The slides should also show your own independent thinking about legal software applications. The slides should include generalizations about how law offices can use software and also some specific skills you learned. All slides must be free of grammar and spelling errors.

In
this scenario the landlord for Slumlord Strip Malls property had the
responsibility to provide reasonable care to his tenant (Sues Sweets)
who has a shop and it attracts customers as third parties. The landlord
owes a duty of care to tenants and he is required keep the premises in
good condition to avoid severe injuries or damages.

If
part of the premises for common use by the tenants is controlled by the
landlord, he has the responsibility of keeping the environment safe for
conducting business. The proprietor is not completely insulated from
recovery of damages or injuries suffered by third parties or tenants.
The third party (Justin) has the right to sue Sues Sweets who is the
owner of the shop where he fell on the icy curbs. It was the
responsibility of the owner of the shop to maintain the area within the
shop to avoid damages and injuries. From a legal perspective the owner
of the shop was the current tenant to the premises owned by the
landlord; the tenant cannot compensate Justin for his injuries since
whatever caused injury is not part of the tenants shop but part of the
premise developed by the landlord.

All
through, the landlord has been acting negligently by not maintaining
the sidewalk nor the curbs and parking lot, where Justin fell. The
landlord knew very well that if one fell down on the damaged curbs
he/she may suffer injuries .He could have foreseen the damages that will
occur to Justin and he would have repaired the icy curbs. The landlord
acted negligently since he had foreseen the danger the damaged icy curbs
could cause to the people yet did nothing. Since he was the
owner/proprietor of the premises he had the responsibility to provide
reasonable care for his tenants and other third parties. The landlord of
the premise is liable and not Sue Sweets as the tenant of the shop.

In
my view the pleadings brought in by Sues Sweets as a shop tenant will
be accepted in Florida courts. This is so because the landlord owes him
and other third parties duty of care as long as damages or injuries
resulted from an aspect relating to the premises as a whole. If at all
the landlord had maintained the icy curbs in good condition then Justin
could not have suffered personal injuries. According to Florida rules
the pleadings by Sues Sweets will be accepted since he is a party to the
landlord tenancy agreement. On the other hand Justin cannot file an
opposition complain stating that it is late for amendments to the suit
since Sues Sweets has the right to file his complain as he/she is part
of the agreement to which every party is given fair hearing before the
law. The question is Do you think there is a legitimate argument here that the third party
complaint is simply too late in litigation? Why or why not?
