Question 2

Question 3
Cost reimbursable contract calculation.
- A contract calls for a total payment of $800,000 with a guarantee. Essentially the contractor is guaranteed to make at least $200,000 above his costs. If the contractor can demonstrate his costs exceed $600,000, the project will pay the difference, with a $50,000 ceiling on the overage. The contractor demonstrates he spent $623,000. How much (gross) must the project remit to the contractor?
- Another option for the same contract has the contractor guaranteed to be paid his costs plus 20%, for costs that exceed $600,000. With the same initial assumption—guarantee of $800,000 gross payment (no requirement to itemize costs), but if the contractor can show that costs exceed $600,000, the project will pay $800,000 plus the costs that exceed $600,000, plus 20% of those excess costs, with a ceiling of $900,000 gross. The contractor demonstrates he spent $623,000. How much (gross) must the project remit to the contractor?
- Under option 3.2, at what dollar amount of total costs would the contractor be assuming all of the excess costs beyond that point?
- In which option did the project assume more of the risk of a cost overrun? Explain.

Financial Statement Fraud – Has SOX been a help or a hindrance? Business Finance Assignment Help
Please refer to these resources for this discussion:
- Chapters 11, 12, and 13 in the Albrecht textbook
- Financial Statement Fraud (Crazy Eddie’s) video
- Smartest Guys in the Room – Enron documentary
we had the opportunity to explore some of the more egregious financial statement frauds from the past two decades. Many of these occurred prior to the enactment of Sarbanes Oxley (Enron, Worldcom, Waste Management, Adelphia, Tyco, Healthsouth, Qwest Communications, Cendant, and others). Other cases of financial statement fraud have surfaced after SOX was enacted, including Lehman Bros. and Fannie Mae.
Choose one of the pre-SOX financial statement fraud cases and write a brief summary (2-3 paragraphs) that outlines:
- What happened?
- Who was involved?
- How did they do it?
- How were they caught?
- What were the results (for both the victims and the perpetrators)?
In addition to this summary, write a brief evaluation of how you think SOX might have impacted and/or changed your case study. Would it have still been likely to occur? Would it have been reduced in severity or duration? How might it have changed things for the victims? the perpetrators? For this part, I recommend that you refer to Appendix A at the end of Chapter 11 in the textbook and the discussion that ensues there, including the consideration of the Fraud Triangle presented in Table 11A.1. Would SOX have made a difference in your chosen case? If so, how? If not, why not?
There are, of course, widely varied opinions of the effectiveness of SOX. Kayla Gillan, a former deputy chief of staff to the Chairman of the SEC, believes that SOX has been a beneficial and successful new law. She believes that, while no legislation can entirely eliminate financial statement fraud, SOX has been effective in rapidly increasing investor confidence. Despite acknowledging that SOX has increased the cost of participating in capital markets, she stated that many believe that the benefits far outweigh the increased costs. She believes that internal controls are more effective, auditor standards are more stringent, auditors are more competent and engaged, and the SEC has become more effective. She believes that the purpose of SOX legislation was to enhance investor protection and that it has largely accomplished this.
On the other hand, there are those that believe that SOX has largely been a failure. Billionaire investor Mark Cuban, when considering the SEC and the experiences of startup companies, feels that SOX has made it much more difficult for companies to go public because of the increased costs associated with SOX. There are many more opinions on both sides of this argument. When it comes to preventing and reducing financial statement fraud, what do you think? Has SOX been a help or a hindrance?
In summary, for this discussion (per the guidelines above):
- Write a 2-3 paragraph summary of a pre-SOX case study of financial statement fraud.
- Write a brief evaluation of how you think SOX might have impacted and/or changed your case study.
- Discuss whether SOX has been successful in reducing financial statement fraud.

Woodward and Scott Armstrong. You must answer both questions listed below.
Please read and answer ALL questions from the required reading.
1. Recently, you learned about conference voting, opinion assignment, and the opinion writing
process. Please explain what this process typically looks like. [One paragraph]. Find an
example of opinion assignment and bargaining from this reading (1973-1974) of The Brethren.
What is the case? Who wrote the majority opinion? Did this transpire in typical fashion (i.e.,
the way you learned in lecture) or was it somewhat unique? [1-2 paragraphs]. Compare this
case to the events that transpired in United States v. Nixon. Who was assigned the opinion in
this case and who ultimately wrote it? How did this come about? [1-2 paragraphs].
(2) The Brethren offers an unprecedented perspective into one of the most secluded and
enigmatic branches of our national government. Yet despite the striving for neutrality it is
obvious that certain justices are portrayed in a less favorable light. Did the book present an
objective or biased account of the Supreme Court? [1 paragraph]. Reading the book, did you
find it helpful in understanding legal concepts and how they relate to the Supreme Court? [1
paragraph]. Should the Supreme Court be more forthcoming about its operations, or should
it be allowed to have its space and privacy? Why or why not? [1 paragraph]. Do you think
that the book’s description of the Supreme Court will offer lessons that will last across
generations, or only useful in understanding the operation of the Burger Court? [1-2
paragraphs].
