Discretionary Use of Authority: Scenarios

Because of the nature of law enforcement work, police officers have always maintained a certain amount of discretion. Due to the amount of interaction that officers have with members of the public, this discretion must be fair, equal, impartial, and legal. As such, the use of discretion by officers is both a foundation of police work and a component of community policing.

Review the below scenarios. For each scenario, provide a justification for every possible response (Part A). In your justification, include the factors that support or influence each response. In Part B, choose how you personally would respond, provide a rationale for why you feel it is the most appropriate response for the scenario, and explain the role that discretion played in your decision.

Using Microsoft Word, copy the scenarios, and provide your answers directly in Parts A and B under each question.

Scenario 1: You respond to a call of a theft. Upon arrival, you find that an 18-year-old female has stolen baby formula and diapers by exiting the store without paying. You speak with her and find that she has a newborn baby, does not have any source of income, and needed the formula and diapers for the baby. As such, theft is still a crime. Do you arrest the woman or not? Why?

Part A.

Scenario 1
Possible Response Justification for This Response
I choose to arrest the woman.
I choose not to arrest the woman.

Part B.

  • Which response would you choose and why? Also, explain the role of discretion in your response.

Scenario 2: You respond to an armed robbery. You notice an individual matching the description of the offender. As you approach him, you observe what appears to be a gun in his waistband. Do you immediately attempt to stop him? Or do you wait for backup? Why?

Part A.

Scenario 2
Possible Response Justification for This Response
I immediately attempt to stop him.
I wait for backup.

Part B.

  • Which response would you choose and why? Also, explain the role of discretion in your response.

Scenario 3: You stop a 16-year-old for going through a red light. He explains to you that he is late for work. Do you give him a ticket?

Part A.

Scenario 3
Possible Response Justification for This Response
I write the juvenile a ticket.
I choose not to write the juvenile a ticket.

Part B.

  • Which response would you choose and why? Also, explain the role of discretion in your response.

Scenario 4: You arrest a male individual. Just as you place the handcuffs on him, he breaks free and jumps into a nearby contaminated lake in order to avoid arrest. What actions do you take? Who do you notify? Do you jump in the lake?

Part A.

Scenario 4
Possible Response Justification for This Response
I choose to jump in the lake.
I choose not to jump in the lake.

Part B.

  • Which response would you choose and why? Explain the role of discretion in your response. Also, explain the legal and moral considerations affecting your decision.

Scenario 5: As a police officer, you are assigned to the same location every day. You become very familiar with the crime that takes place, specifically drug sales, robberies, and shootings. You are aware that a specific gang is responsible for the majority of the crimes. The gang members are all male, are of the same race, wear the same colors of clothing, and populate the exact area that you are assigned to during the time that these crimes take place. While on patrol, you observe the individuals matching the description of the gang members committing all of these crimes. The citizens are calling for the police to take action. What behaviors raise your suspicion? What action do you take? Do you stop these individuals? Do you search these individuals? How do you go about investigating these individuals?

Part A.

Scenario 5
Possible Response Justification for This Response
I choose to take action against the gang.
I choose to take some action.
I choose to take no action.

Part B.

  • Which response would you choose and why? Explain the role of discretion in your response. Also, explain any Supreme Court cases affecting your decision.

Competency:

Evaluate regulatory compliance in the business environment.

Scenario:

You work in the marketing department of a U.S. based company that produces bottled water. Your state university just published a report on their year-long study of bottled water, which concluded there is virtually no health advantages in bottled water over tap water. Your company has been working on a campaign strategy focusing on the health benefits of bottled water over tap water. This strategy resulted in a celebrity endorsement and media blitz that cost the company $105,000.00 in time, money and other resources. The CEO does not want to suspend the campaign and start over but rather wants to move forward in launching with social media, TV, radio, and newspaper ads. You decide to present the dilemma to your marketing team so as a team you can address the issues before the campaign launches.

Instructions:

Create a PowerPointpresentation for the marketing team that includes slides that evaluate the particular business situation, the regulatory compliance involved, as well as the benefits and disadvantages of moving forward with such a marketing campaign.

Business Laws in the US Corruption Questions Law Assignment Help

1) In the video clip “Complying with the FCPA”, attorney Paul McNulty discusses Foreign Corrupt Practices Act enforcement. What are some policy reasons that the U.S. government may have for prohibiting U.S. companies from bribing foreign officials in order to get international business? Consider that if U.S. companies are winning contracts abroad, it can result in more jobs in the U.S. and a stronger domestic economy.

2) In the U.S. Dept. of Justice Antitrust Primer, the DOJ describes common types of illegal, collusive activity among competitors. Do you believe that cooperation among competitors may be justified in certain scenarios? For example, since a greater number of “brick and mortar” bookstores (i.e. Borders) seem to be facing bankruptcy, should these bookstores be exempt from antitrust laws and be permitted to engage in market allocation to remain viable? Consider that one of the goals of the U.S. antitrust laws is to ensure that consumers have product choices in the marketplace.

ENGH 202 George Mason University Hellenic Culture & Greek Mythology Discussion Humanities Assignment Help

Q. The Gods’ Role, and What That Says about Hellenic Culture

Ans: If you have studied Greek mythology, you might have learned that Ares is the god of war. That is inaccurate. War is too great a part of ancient life to be covered by one god. Ares is more properly thought of as the god of battle and of bloodlust. Pallas Athena is equally associated with war, but she is known more for strategy and skill. Meanwhile, the Greeks embody other attributes of battle in lesser deities such as Eris (Strife) and Rout. Consider the gods’ role in the war and their place in the story. Why are both so significant? What do the gods’ characters, behavior, influence, and interference say about Hellenic (Greek) culture and the way the people perceived and understood the world?

Quoting and citing:

Iliad is written in verse. That means line-breaks and capitalization matter. When you quote, mark line-breaks with a forward slash with a space on each side: “Zeus, clouds scudding around him: / ‘Better to put Athena on him / She’s always been the best at giving him grief’” (5.816-18). Note also that the citation belongs after the quotation marks but before whatever punctuation you want to use after the quotation.

If a passage of verse you want to quote is longer than three lines, block-quote it. That means you should skip down to the next line, you do not add (or remove) quotation marks, you reproduce the format of the lines as closely as possible, and you do not need punctuation after the citation:

The reins slipped out of Nestor’s hands,

And with fear in his heart he said to Diomedes:

“Son of Tydeus, turn your horses around.

Zeus has given this man the glory today.”  (8.141-44)

Note that all four of these lines are part of the quotation, but the third and fourth lines are in quotation marks in the text.

To cite quotations in these posts, use the book number and the line numbers of the specific passage; for example, (8.141-44) means Book 8, lines 141 through 144. You do not need the author’s name in the citation because that will be obvious.

Walden University Ethical Leadership Participative Leadership Student Response Business Finance Assignment Help

Assignment: Do some extra research on any leadership theory that interests you. Briefly discuss the premise of the theory and what you found. Use the APA citing and referencing format.

Participative Theory of Leadership

This leadership theory suggests that the ideal leadership style takes the input of others into account, according to Cherry (2019). These leaders encourage participation and contributions from group members and add to group members feeling more relevant and committed to the decision-making process.

Several historical studies have been performed on Participative leadership. The leadership theory’s roots are often traced back to an experiment in the 1930s, famously known as the Hawthorne experiments. According to Belyh 2020, the findings relating to participatory leadership saw light in the 1950s. Researcher Henry A. Landsberger found that workers’ productivity increased during participation in the experiment, dubbed as the Hawthorne effect. The experiments show that when employees feel supported through observation and participation, they are more satisfied, and therefore, productivity increases.

One of the most apparent benefits of the theory is the increased number of opinions involved in decision-making. Because of the participatory nature in decision-making, the overall work morale can improve, according to Belyh 2020. Furthermore, when the subordinates have been able to have a say in the policies, projects, or processes, they are more likely to accept them.
