Answer at least ONE Question for each author. If you like, you can answer more or you can reframe ideas, so long as you produce about 200 words on each author. As always, use close reading and textual support in your writing.

“Hard-Riding”

  1. Is Mather’s proposal a logical one? Why or why not? On what basis is that logic built?
  2. Is the group’s alteration of Mather’s plan a logical one? Why or why not? On what basis is its logic built? (McNickle offers another “logic,” the logic of communal needs and obligations over financial expediency, and the latter is proffered as a distinct and viable alternative to that of “modern, commercial America.”)
  3. What is the significance of the title? How does McNickle’s description of Mather’s riding style reflect or imply the author’s evaluation of governmental policy-making?

Paredes

  1. What does the Rio Grande symbolize for Paredes? How does he employ landscape to convey a sense of identity and/or dislocation?
  2. What does the refrain “The White Woman walks in moonlight” mean in “Night on the Flats”?
  3. What are the conflicts in loyalty in “When It Snowed in Kitambamba”? How is this story atypical of most WWII literature? How does the concept of transnationalism help explain that peculiarity?
  4. What are the specific conflicts in character and culture the protagonist of “Ichiro Kikuchi” feels being the child of “mixed” heritage?

González

1. What are the conflicts in character and culture between the two muses?

2. Is there a feminist message in this story? If so, why do you think the author chose two “early” female writers from strict religious cultures to carry it?

    Overview

Suppose you are a CPA, and you have a corporate client that has been operating for several years. The company is considering expansion through reorganizations. The company currently has two subsidiaries acquired through Type B reorganizations. The client has asked you for tax advice on the benefit of Type A, C, or D reorganization over a Type B reorganization. Additional facts regarding the issues are reflected below.

    • The company currently files a consolidated income tax return with the two subsidiaries acquired through a Type B reorganization.
    • ABC Corporation, a subsidiary targeted by the client for takeover, has substantial net operating losses.
    • XYZ Corporation and BB Corporation will be acquired as subsidiaries in the next six months.

    Instructions

Use the Internet and Strayer Library to research the rules and income tax laws regarding Types A, B, C, and D reorganizations and consolidated tax returns. Be sure to use the six-step tax research process in Chapter 1 that was demonstrated in Appendix A of your textbook as a guide for your written response. Write a 4–6 page paper in which you:

    1. Compare the long-term tax benefits and advantages of each type of reorganization and recommend the type of reorganization that will be most beneficial to the client.
    2. Suggest the type of reorganization the client should use for the ABC Corporation based on your research. Justify the response.
    3. Propose a taxable acquisition structure for the client’s planned acquisitions over a nontaxable reorganization. Assess the value of a taxable transaction over a nontaxable reorganization for the client.
    4. Examine the value and limitations of including the ABC Corporation if acquired as a wholly-owned subsidiary in the consolidated return and provide a recommendation to your client. Support the recommendation with applicable research.
    5. Create a scenario that will allow the client to reduce any disadvantages from filing a consolidated return as a member of a controlled group.
    6. Use the six-step tax research process located in Chapter 1 and demonstrated in Appendix A of the textbook to record your research for communications to the client.

Psychology simulations on excel Humanities Assignment Help

I’m working on a psychology question and need an explanation to help me understand better.

Simulate recognition data with Excel

Generate a “study list” of 10 items, represented as vectors (can use simple 4 feature items as in the example, or more complex). There are no specific rules for what these items must look like – they can be any combination of 4 numbers, but I recommend using single digits as in the example from lecture.

Parameters: u (probability of encoding)si (probability of source being the item itself)sr (probability of source being a random number) Note: sr = 1-si, this is simplified from the real model.c (probability of copying correctly)Here are some suggested starting values for your parameters:u = 0.3, si = 0.7, sr = (1-si) = 0.3, c = 0.8

Use the parameters above to create 10 memory “traces”, as if a subject were going through the process of encoding these 10 items. When creating these 10 traces, use the process described below:

1. Each feature of each study item presented is

a. Encoded with some probability u

b. The source of representation is chosen with probabilities si (from item) and sr (random choice)

c. Feature is copied correctly with some probability c (if not copied correctly, replace with random value)

WHAT TO TURN IN

:1) Show the 10 original items that make up the study list (this will be a list of 10 vectors).

2) For one run of the loop described above, show the memory “traces” after study as 10 vectors, which should be imperfect and incomplete copies of the study items.

3) Come up with a (simple) way to compare each trace to each actual item from the study list to give each simulation run a memory “score”. Run the simulation 100 times, plot a histogram of the memory scores, and show the average of the 100 memory scores.a. Extra credit: Complete step 3 several times, changing parameters like u and c, to see how the memory score changes. Plot a histogram for each run to see the effect of varying your parameter.

4) Attach your Excel File showing your simulation.

Trademark Law

undefined

Trademarks are one of four different commercial guarantees that consumers use to distinguish the products and/or services of one merchant from the products and/or services of another merchant in the marketplace. The other ways are via copyrights, patents, and trade secrets. Trademarks are also one of four different varieties of marks. Trademarks, such as CHEERIOS(R) or LEXUS(R), distinguish tangible goods. Service marks, such as OLIVE GARDEN(R) or FEDEX(R) distinguish services. Certification marks, such as the Good Housekeeping and the Underwriters’ Laboratories seals of approval, distinguish certain features of a good or service. Collective marks, such as OMEGA PSI PHI(R) and AMERICAN BAR ASSOCIATION(R), distinguish membership in a specific organization.

undefined

The four traditional types of trademarks are words, names, symbols and devices. In addition, the U.S. Supreme Court has ruled that there are also nontraditional types of trademarks:

undefined

“Since human beings might use as a “symbol” or “device” almost anything at all that is capable of carrying meaning, this language, read literally, is not restrictive. The courts and the Patent and Trademark Office have authorized for use as a mark a particular shape (of a Coca-Cola bottle), a particular sound (of NBC’s three chimes), and even a particular scent (of plumeria blossoms on sewing thread).”

undefined

Matty tells us that these nontraditional marks are beneficial because they acknowledge the ability of merchants to appeal to all five senses of the consumer in very distinctive ways. Todd adds that any of these traditional and/or nontraditional marks can be combined to produce a total image that is referred to as trade dress.

undefined

The United States is unique in the world in trademark law, in that trademarks here are initially governed under the common law by their adoption and usage, not by their registration. So, while registration is not required, per se, for a trademark, it is necessary for merchants to register their trademarks with the United State Patent and Trademark Office (USPTO), if the trademark is used in an interstate capacity, or with the state trademark office, if intrastate, so that the merchant will be able to more easily bring court action against any party that the merchant believes has infringed on their trademark protections. Furthermore, when the merchant has paid a registration fee of $225.00 per mark per class of product or service to the USTPO to obtain an interstate trademark, that merchant will thusly provide national notice and deterrence to all other merchants of his/her trademark through the USPTO database; have international treaty trademark protection and U.S. export protection; and secure the right to use the (R) symbol in conjunction with his/her trademark.

undefined

According the the USPTO website, there are five steps that a merchant must follow to secure a trademark: (1) determine if you need to register; (2) prepare everything that is needed to apply; (3) submit the online application; (4) work with the assigned USPTO; receive acceptance or denial; and (5) maintain the trademark as required. Of these steps, the first two are extremely important for new merchants who are starting a business and wish to trademark their logos. These first steps will allow the new merchants to search the USPTO database to make sure that their logo is not too similar to an existing trademarked logo. Another thing that a new merchant may want to consider is the extent of the use of the trademark. Because, if its use is only local or within the boundaries of one state, it is not necessary to register the trademark with the USPTO.

undefined

Finally, Isaiah 35:8 (KJV) speaks of fools who are in need of protection upon the highway. This biblical passage, I believe, speaks to the foundation of trademark law, in that trademarks are used to protect the general public from being made into fools by unscrupulous merchants who would pretend that their lackluster products and/or services are someone else’s.

Trademarks are used in the marketing of a given product and there are a total of four different types. Deborah E. Bouchoux, Intellectual Property: The Law of Trademarks, Copyrights, and Trade Secrets (5th ed. 2018). The first type is trademarks and there are four different kinds that can be used; the first type is words, examples would be REEBOK®, Rainbow®, or Columbia®. Id. The second kind is slogans; an example of this kind of trademark would be American Runs on Dunkin’ ® for Dunkin’ Donuts. Id. Designs is the third kind of trademark; the “Converse All Star” star in the middle of a circle is the design trademark for the Converse shoe company. Id. The fourth and final kind of trademark is sound; a great example would be the lion’s roaring at the beginning of a Metro-Goldwyn-Mayer produced film. Id. Service Mark is a type of mark and they are a word, name, symbol, or device that is used to identify a service. Id. Examples of a service mark is Texas Roadhouse for restaurant services and Microsoft Suites for computer programs. Next type is certification mark, and it is a word, name, symbol, or device that is used by a person within commerce that particular goods and/or services have certain features in regards to quality, accuracy, materials, etc. Id. An example of certification mark would be EPA’s “Energy Star” mark that is on household appliances that are found to meet energy efficient standards. The last type of mark is the collective mark and it is defined as being a mark used/owned by a collective membership organization. Id. Fraternities, sororities, and professional societies are all examples of a collective mark. Id.

undefined

Registration is not a requirement for securing protection for a trademark, but there are several advantages that come with registering a trademark. Id. The reason that registration is not required is because within the United States, a trademark is usually protected from the moment it is first publicly used. Id. As mentioned above, there are several advantages to registering a trademark, as well as disadvantages. Id. Some advantages of registering a mark include: allowing the registrant to bring an action in federal court for any infringement of the mark; it is visible intellectual property; notice to the public of owner’s claim to said mark is made; right to obtain registration in foreign countries due to the right found under the Paris Convention; etc. Id. Some disadvantages of registration are: registration is only valid for 10 years; in order for a mark’s registration to be renewed for 10 more years, it must be used in interstate commerce; it is required that the registrants file an affidavit with the USPTO; and the process for registering a mark is an extremely long process, usually 10 to 24 months if not longer. Id. There is a filing fee for registering a mark and it is $225.00 per mark per class of goods and/or services. Id.

undefined

There is a process that one must go through in order to register a trademark. First step is getting ready to apply by selecting a trademark and determining the type of protection that will be needed for that mark. Trademark Process, USPTO.gov (March 31, 2021), https://www.uspto.gov/trademarks/basics/trademark-process#step6. The second step is preparing ands submitting a Trademark Electronic Application with the USPTO by going through their online portal. Id. Applicants must pay an application fee which is actually a processing fee; applicants are also responsible for monitoring the status of their application. Id. Next, the USPTO reviews an individual’s applications and issues a letter to the applicant if the examining attorney believes that a mark can not be registered, in which the applicant must reply to said letter in a timely manner. Id. The next step is that the USPTO either approves or denies an individual’s application. Id. If an application is approved, then the USPTO will publish the mark. Id. It is the responsibility of the applicant to continue filing the necessary and specific maintenance documents in order to keep their mark(s) active/”alive”. Id. Last step is that the applicant must renew their mark’s registration once the 10 years is up if they so wish. Id.

undefined

I would give a new business enterprise lots of advice concerning trademarks and the process they need to go through. Whenever a new business is looking to trademark their logo, they need to make sure to put in the time to review their mark so that there is no possibility of it being excluded from protection under the Lanham Act. Bouchoux, supra. A business will also need to research to make sure their mark does not require consent from a living person. Id. I would advise a business that is using a foreign term that they need to make sure they translate the word(s) to confirm that there is no deception involved. Id. Another piece of advice I would give to a new business is that it is important for them to triple check (at the very least) that their selected mark is not similar in a confusing way with a mark that is already registered, pending registration, or in use on a basis of common law. Id. Hiring an attorney who specialized in Trademark law is an additional piece of advice that I would give a new business. Id. Lastly, I would advise a new business to take the time to register their trademark because of all the advantages that come along with registration. Id.

No, I do not believe that there is a situation where I would not recommend registering a trademark. Even though it is a long process and the registrant has to eventually renew their mark’s registration, the advantages that come with registering a trademark outweigh those two negatives in my opinion. Also in my opinion, I believe that trademark protection is in agreement with biblical principles that are laid out in the Bible for us. The Bible says, “Give to everyone what you owe them: If you owe taxes, pay taxes; if revenue, then revenue; if respect, then respect; if honor, then honor;” this scripture fits with trademark protection because it tells us to hone, respect, and give revenue to those who are owed it, and by having trademark protection it allows for honor and payment that is owed to be given to said business or organization along with keeping other businesses from using that said trademark to make a profit or receive a credit that is not rightfully theirs. Romans 13:7 (NIV).

Diagnostic Analysis

Cardiac radio-nuclear scanning, EKG, and studies ruled out the possibility of MI. Troponins and serial cardiac enzyme indicated cardiac ischemia. Stress testing and a nucleotide scan indicated that the patient was having exercise-related myocardial ischemia (angina). Echocardiography indicated that the heart muscle at the site of ischemia was functioning poorly. Transesophageal echocardiography indicated that the patient had mitral regurgitation. Cardiac catheterization with cineventriculography demonstrated near-normal ventricular function, and coronary angiography indicated significant narrowing of the left coronary artery. Mitral regurgitation was also seen. The patient’s angina was then thought to be caused by the coronary artery disease. Open heart surgery was performed. The patient’s mitral valve was replaced with a prosthesis, and an aortocoronary artery bypass graft was performed. Postoperatively, he had a large pericardial effusion. This diminished his heart function. He underwent pericardiocentesis, and his function improved. Because his serum lipids study showed type IIa hyperlipidemia, a low-cholesterol diet and cholesterol-lowering agents were prescribed. The other cardiac risk factors did indicate increased risk for coronary heart disease. Six months later he was asymptomatic and jogging 3 miles per day.

Questions:

1. Based on the ratio of cholesterol to HDL, what is the patient’s risk for coronary heart disease?

2. If these blood tests were drawn 1 year ago, what treatment would have been indicated?

3. Could surgery have been avoided?

For this assignment, required APA format will consist of a title page with a running head and reference page with citations in proper format.

Information:

Every director should be able to analyze a budget sheet and determine if the center will break even, make a profit, or have a deficit. Armed with this knowledge, the director can then make any necessary adjustments to ensure the center is financially sound.

This activity is designed to introduce you to a simple budget and familiarize you with the task of reading a spreadsheet and analyzing where problems exist. Once you have determined the problem area or areas, you will make adjustments so income equals or exceeds expenses.

Readings for this assignment:

To help you understand the importance of budgets to the success of any center, review the materials provided in the week 10 folder as follows:

1) Analyzing Financial Information

2) Making the Budget Work

3) Is Your Center in Good Financial Health?

4) Surviving Tight Times

5) Iron Triangle

6) How To Make a Basic Budget

What To Do:

1) Review the three budgets, located in the week 15 folder. Spend some time comparing the budgets, side-by-side, item-by-item. You will see that some items are identical and some are very different, as is the bottom line. For this assignment, you will compare each budget for the current year to the draft budget for the coming year – three (3) comparisons in all.

2) Of course, you do not have all the information needed to analyze these proposed budgets in depth, but your task is simply to find any items that seem unreasonable or out of balance with the current year’s budget. It is to be expected that certain expenses (such as payroll and accompanying taxes) increase each year, but that increase usually is between 3-10%.

3) Using your common sense and any information gleamed from the articles or other experiences you have had with balancing budgets, identify any specific items which seem unreasonable or out of balance.

4) Complete sections I, II and III for submission.

Section I

1) Create a document responding to the following items for each draft budget in turn:

  • After reviewing the income section, are there any items that seem unreasonable to you? Why do you think so?
  • After reviewing the expenses section, are there any items that seem unreasonable to you? Why or why not?
  • What suggestions do you have to balance each of the budgets? Does your newly balanced budget include funds for capital improvements? Why or why not?

2) Revise each of the budget sheets so that income and expenses are in balance or there is a reasonable surplus; and respond to the following items for each revised budget in turn:

  • Does your revised budget require an increase in fees? Why or why not? If fees are increased, how will this information be shared with parents? If fees are not increased, how will you fund expected increases in fixed costs such as insurance and utilities?
  • Does your revised budget include a pay raise for staff members? Why or why not? If a pay raise was factored into expenses, how would the amount of raise be determined for each staff member?
  • Is it possible to reduce expenses while still providing a high-quality program for children and families? Which, if any, specific expense items have a direct effect on the quality of program children receive?

Section II

Ensuring that fiscal matters are in order is one of the more pragmatic responsibilities of a director with potential repercussions that affect everyone involved – children, families and staff members. Take some time to think of the myriad of ways a center’s financial health impacts a center program.

As closure for this assignment, write a short essay covering the following points:

  • How does the state of a budget affect the quality of a program? Give specific examples based on your experience in the field.
  • What effect might a budget have on working conditions as well as staff turnover and morale? As a director and center leader, what can you do to ensure that morale is high and staff turnover low no matter what the state of the budget?
  • In way ways does the state of the budget affect children enrolled in the program and their parents?
  • Looking at a larger picture, are there any cultural, political or financial conditions that may have an effect on a center’s budget?
  • In your opinion, what is the most important single thing for a director to understand about the center budget?

Section III

  • Save each of your revised budgets, demonstrating how you managed to balance them, either breaking even or hopefully with a small surplus for the year.

Completed Assignment

  • Submit your written document with responses to all questions/items in sections I & II. Be sure to cover each bulleted item thoroughly.
  • Submit section III with each of the three (3) revised budgets.

BE AWARE THAT TOTAL EXPENSES CANNOT EXCEED TOTAL INCOME FOR EACH BUDGET. IT IS YOUR TASK TO BALANCE EACH BUDGET. ALSO, BE AWARE THERE ARE NO ABSOLUTE RIGHT ANSWERS, JUST REASONABLE ONES.

Be sure to use the six-step tax research process in Chapter 1 that was demonstrated Business Finance Assignment Help

I’m working on a management writing question and need an explanation to help me learn.

  • Reorganizations and Consolidated Tax Returns

This course requires the use of Strayer Writing Standards. For assistance and information, please refer to the Strayer Writing Standards link in the left-hand menu of your course. Check with your professor for any additional instructions. The specific course learning outcome associated with this assignment is:

I’m working on a management writing question and need an explanation to help me learn.

  1. Reorganizations and Consolidated Tax Returns

    Overview

Suppose you are a CPA, and you have a corporate client that has been operating for several years. The company is considering expansion through reorganizations. The company currently has two subsidiaries acquired through Type B reorganizations. The client has asked you for tax advice on the benefit of a Type A, C, or D reorganization over a Type B reorganization.

Be sure to use the six-step tax research process in Chapter 1 that was demonstrated in Appendix A of your textbook as a guide for your written response.Write a 4–6 page paper in which you:

    4. Examine the value and limitations of including the ABC Corporation if acquired as a wholly owned subsidiary in the consolidated return and provide a recommendation to your client.

Analyzing Financial Information and Is Your Center in Good Financial Health Paper Humanities Assignment Help

I’m working on a english writing question and need guidance to help me study.

Introduction:

Your assignment is to review three draft budgets for the coming year, prepared for the same program, comparing each to the budget for the current year. After analysis, you will recommend any changes to allow for a balanced budget or even a surplus!

The provision of high-quality care for young children is expensive and funds must be allocated properly to provide a developmentally sound program. No matter how good the intentions of the staff, a program cannot continue to operate for long without a balanced budget. Directors are responsible for the center’s proper fiscal management, and for ensuring that needs of children, staff and parents are considered when a budget is created.

APA Format:

Id.

The patient was a 48-year-old man admitted to the coronary care unit complaining of substernal chest pain. During the 4 months preceding admission, he noted chest pain radiating to his neck and jaw during exercise or emotional upsets. The pain dissipated when he discontinued the activity or relaxed. The results of his physical examination were essentially normal except for a systolic murmur heard best at the apex of the precordium and radiating into the left axilla.

3. Could surgery have been avoided?

suppose you are a CPA, and you have a corporate client that has been Business Finance Assignment Help

Be sure to use the six-step tax research process in Chapter 1 that was demonstrated in Appendix A of your textbook as a guide for your written response.Write a 4–6 page paper in which you:

    4. Examine the value and limitations of including the ABC Corporation if acquired as a wholly owned subsidiary in the consolidated return and provide a recommendation to your client.

APA Format:

Id.

Id.

Id.

3. Could surgery have been avoided?

suppose you are a CPA, and you have a corporate client that has been Business Finance Assignment Help

Be sure to use the six-step tax research process in Chapter 1 that was demonstrated in Appendix A of your textbook as a guide for your written response.Write a 4–6 page paper in which you:

    4. Examine the value and limitations of including the ABC Corporation if acquired as a wholly owned subsidiary in the consolidated return and provide a recommendation to your client.
