First Amendment provides students and staff members protection of the law for their freedom of speech, the freedom of expression or press, and the freedom of religion. While schools do have some power to censor aspects of the First Amendment, the courts have been careful not to infringe on student or staff First Amendment rights.

The Fourth Amendment – This amendment gives staff and students a level of privacy. Much like the First Amendment, schools do have some ability to ignore privacy as long as the districts can prove that it was essential to the educational process.

Malpractice insurance helps protect professional advice- and service-providing individuals and companies from bearing the full cost of defending against a negligence claim made by a client, and damages awarded in such a civil lawsuit. This insurance focuses on alleged failure to perform on the part of, financial loss caused by, and error or omission in the service or product sold by the policyholder. These are causes for legal action that would not be covered by a more general liability insurance policy.

Professional malpractice insurance may take on different forms and names depending on the profession, especially medical and legal, and is sometimes required under contract by other businesses that are the beneficiaries of the advice or service.

Advantages of medical malpractice insurance.

In the event that you make an error you won’t have to pay the claim or settlement out of your own savings.

You have a lawyer to assist you in court.

Disadvantages of medical malpractice insurance.

In the event that you make an error you can be sued personally and if the judge finds you at fault, then you will have to pay on your own.

William has been notified that he and Dr. Chen are being investigated for Medicare fraud due to fraudulent up charging of visits and documentation errors. One such case includes his visit with Charles. William no longer works at Highland Internal Medicine, having left the practice 18 months ago in 2019. William has also been notified by his State Board of Nursing that he is under investigation concerning fraud.

Highland Internal medicine used an outside company to help with billing and coding. William does have documentation through email that he agreed to this practice, and he checked the box for automatic update, waiving his right to review the coding before it was submitted for billing.

The billing and coding company went back and documented that William also saw Charles for and managed his chronic conditions at the visit on top of his annual Medicare wellness exam. William knows he did not cover or document on the management of these conditions as they were controlled or being managed by other specialists.

When we think of malpractice, we often think of harm to patients and not the other aspects of malpractice. Malpractice can include fraudulent billing. It is important to note if your malpractice policy covers fraud as not all liability insurances will cover fraud charges. In 2019, the Department of Justice found over $2.6 billion in health care fraud with $3.6 billion returned to the federal government between 2018 and 2019. There were 1,060 new criminal investigations in 2019 (Department of Justice, 2020, [PDF]).

It is key to make sure you are documenting accurately as well as checking any coding and billing you complete or that is completed on your behalf. Fraud charges can not only lead to financial risk but also detainment in a federal prison.

How does the mind perceive all the various objects of its knowledge?

The four different ways of perceiving things.

How we know God.

How we know bodies.

How we know our own souls.

How we know pure spirits and the souls of other men.

1. THE FOUR WAYS OF PERCEIVING THINGS

There are four ways in which the mind knows things.

To know things by themselves.

We know things by themselves and without ideas when they are intelligible by themselves.

They can act on the mind and reveal themselves to it.

Understanding is a passive function of the soul, whereas activity (to simply be aware of a thing) is found only in the will.

The soul’s desires are not the true causes of ideas.

They are the occasional (or natural) causes of their presence as a result of the natural laws concerning the union of the soul with universal reason.

To know them through their ideas – through something different than themselves.

We know things through their ideas when they are not intelligible by themselves.

This could be because they are corporeal or because they cannot affect the mind or reveal themselves to it.

To know them through consciousness, or inner sensation.

Through consciousness we know everything that is not distinct from ourselves.

To know them through conjecture.

Through conjecture we know the things that are both different from ourselves and from things we know either in itself or through ideas.

E.g., Such as when we think one thing is similar to another thing we know.

2. HOW WE KNOW GOD

Though our knowledge of him is imperfect, God is the only thing we know through himself.

Because he is the only spiritual being that can act on our mind and reveal himself to it.

We perceive him through a direct and immediate perception.

God is immense, infinite, and without restriction – it is inconceivable that he is perceived through an idea (a particular being that is not universal or infinite).

Only God can enlighten out minds with his own substance.

Only god contains the intelligible world – where all things are located.

It is because of the union we have with him that we know anything in this life.

He enlightens our minds with his own being, and rules it without the mediation of any creature.

We can know corporeal things through their ideas (through God as only he contains the intelligible world – the source of the idea of all things).

Whilst it is possible to know things through God, it is not the case that we do.

We see in God only the things of which we have ideas.

There are things we perceive without ideas and know only through sensation.

3. HOW WE KNOW BODIES

Everything in the world we have knowledge of is either a mind or a body, or a property of a mind or a property of a body.

We know bodies with their properties through their ideas.

They are not intelligible by themselves, so we perceive them in that being that contains them in an intelligible way.

We have a perfect knowledge of bodies and their properties, because they are made intelligible to us through God.

We see their ideas through God.

When we see things as they are in God, we always see them in a perfect fashion.

The way we see things would be infinitely perfect if the mind seeing them were infinite.

The imperfection of our knowledge comes not from a shortcoming of the idea representing the body, but our mind considering/understanding it.

4. HOW WE KNOW OUR OWN SOUL

We don’t see the soul through ideas or through God, but only through consciousness.

Because of this, our knowledge of it is imperfect.

Our knowledge of the soul is limited to what we sense is taking place in us.

If we had never sensed things within us – e.g., pain, heat, light – we would be unable to know whether or not the soul was capable of sensing these things, because we do not know it through its idea.

But if we saw in God the idea corresponding to our soul, we would know, or at least know the properties of which it is capable.

As we know (or at least can know) all properties of which it is capable – because we know extension through its idea.

Through our consciousness or through the inner sensation we have of ourselves, we know that our soul is something of importance.

But what we know OF IT might be almost nothing compared to what it is in itself.

To know the soul perfectly, it is not enough to know only what we know through inner sensation.

As the understanding of the consciousness, we have of ourselves may just be the smallest part of our being.

Although we may have a more distinct understanding of the existence of our soul compared to the understanding of the existence of both our own body and those surrounding us, it is still evident that our knowledge of the soul’s nature is not as perfect as our knowledge of the nature of bodies.

This may be why people differ on their views of the soul.

Some say nothing is known better than the soul, others claim to know nothing less.

It may also prove that the ideas which represent to us external things are not modifications of our soul.

If the soul saw all things by considering its own modifications, it would have to know its own nature or essence more clearly than that of bodies – and all the sensations or modifications that it is capable of, more clearly than what the bodies’ is capable of.

The soul knows it is capable of a given sensation through experience – not the perception it has of itself (through consulting its own ideas).

We may not be able to tell if sensations such as colour and sound are modifications of the soul, but there is no figure that anyone, through the idea they have of extension, would not recognise as the modification of the body.

Modifications of the soul cannot be made known through definition,

Because we do not know the soul (nor its modifications) through ideas but only sensation.

And because such sensations are not attached to any words, we are unable to know them through any definition given of them.

E.g., pleasure, pain, or heat. They are not attached to any words – if someone that had never seen colour then felt heat, they would not know the sensation through definition.

Given that we have sensations because of our bodies (we feel through them), and that our bodies are not all disposed in the same ways, words used to define sensation can be open to interpretation.

It could be that the words used to express the modifications of our soul for one person can be the complete opposite of our intentions.

We can make people think bitterness when we intended to make them think of sweetness.

Although our knowledge of the soul is incomplete, what we do know of it (through consciousness or inner sensation) is enough to demonstrate its immortality, spirituality, freedom and several other attributes we need to know.

This seems to be why God does not cause us to know the soul, as he causes us to know bodies through its idea.

The knowledge that we have of the soul is imperfect, but it is not false.

On the other hand, the knowledge we have of bodies through consciousness or inner sensation is not only imperfect, but also false.

We need an idea of the body to correct our sensations of it, but we need no idea of our soul since our consciousness of it does not involve us in error.

Reason enables us to do this since our idea of the body reveals to us the modalities of which it is capable are quite different from those that we sense.

If we had any further knowledge of the soul – as clear as we do the body – it would lead us more to view the soul as separated from the body.

This would diminish the union between our soul and body by preventing us from regarding is as dispersed through all our members.

5. HOW WE KNOW OTHER MEN’S SOULS

It is only through conjecture that we have knowledge of the souls of other men and of pure intelligence.

We do not know other men’s souls either in themselves or through their ideas. They are also different from ourselves so we can’t know them through consciousness – meaning we must know them through conjecture.

We presume that the souls of other men are the same sort as our own.

We assume that they feel what we feel in ourselves, and even when these sensations have no relation to the body, we know we aren’t mistaken because we see in God certain ideas and immutable laws from which we know with certainty that God acts uniformly in all minds.

There are truths I know to be truth, and we are not mistaken in believing that others know these truths as well I do myself.

E.g., I love pleasure and good, and abhor pain and evil. All men have this inclination.

God will never make a mind that does not desire happiness.

We know this with certainty and evidence because it is God that teaches it to us.

Who else but God could reveal to us his designs and volitions?

When the body plays a part in what happens to us, we will almost always make a mistake in judging others in comparison to ourselves.

The knowledge we have of other men is liable to error if we judge them only by the sensations, we have of ourselves.

My passions will not be the same passions for someone else.

My perceptions will not always be perceived in the same way by someone else.

My sensations will not always feel the same to someone else.

It is an unsound argument that there are beings different to us and to God.

This reinforces the view that since all men have the same nature, we have the same ideas, because we all need to know the same things.[supanova_question]
