Final Contract Analysis

Note: This is a two-part assignment that consists of two different contract analysis scenarios. Please answer both scenarios on one document, and upload it to Blackboard.

Contract analysis scenario one—damages determination: Alfred and Barbara own adjoining farms in Dry County, an area where all agriculture requires irrigation. Alfred bought a well-drilling rig and drilled a 400-foot well from which he drew drinking water. Barbara needed no additional irrigation water, but in January 1985, she asked Alfred on what terms he would drill a well near her house to supply better-tasting drinking water than the county water she has been using for years. Alfred said that because he had never before drilled a well for hire, he would charge Barbara only $10 per foot, about one dollar more than his expected cost. Alfred said that he would drill to a maximum depth of 600 feet, which is the deepest his rig could reach. Barbara said, “OK—as long as you can guarantee completion by June 1, we have a deal.” Alfred agreed, and he asked for $3,500 in advance, with any further payment or refund to be made on completion. Barbara said, “OK,” and she paid Alfred $3,500.

On August 1, Dry County’s dam failed, thus reducing the amount of water available for irrigation. Barbara lost her apple crop worth $15,000. The loss could have been avoided by pumping from Barbara’s well if it had been operational by August 1. Barbara amended her complaint to add the $15,000 loss.

In a minimum of a 1,000-word contract analysis, discuss Barbara’s suit against Alfred. What are Barbara’s rights, and what damages, if any, will she recover?

Contract analysis scenario two—remedies determination: Mundo manufactures printing presses. Extra, a publisher of a local newspaper, had decided to purchase new presses. Rep, a representative of Mundo, met with Boss, the president of Extra, to describe the advantages of Mundo’s new press. Rep also drew rough plans of the alterations that would be required in Extra’s pressroom to accommodate the new presses, including additional floor space and new electrical installations, and Rep left the plans with Boss.

On December 5, the President of the United States announced a ban on foreign imports of computerized heavy equipment. The ban removed—from the American market—a foreign manufacturer that had been the only competitor of Mundo. That afternoon, Boss received an email from Mundo stating, “All outstanding offers are withdrawn.” In a subsequent telephone conversation, Seller told Boss that Mundo would not deliver the presses for less than $2.9 million.

In a minimum of a 1,000-word contract analysis, discuss the following questions: Was Mundo obligated to sell the presses to Extra for $2.4 million? Assume Mundo was so obligated. What are Extra’s rights and remedies against Mundo?

You have read a lot about performance, performance studies, and performance in everyday life. This EA is to help you better understand a particular concept in this field of study: ritual!

Engagement Activity:

My Ritual Self Video Performance: Taking inspiration from course materials and the video provided above, craft a video-based performance that creatively represents an everyday ritual or social drama you have been through.

• What should this look like?
  • This video-based performance can take the form of storytelling, spoken word, a song, performance art piece, etc. Do not be constrained by form, and attempt to exercise your creative muscles!
  • This does not mean you simply recreate the ritual or mime it in the video.
  • You may not simply explain the ritual in the video, you must DO SOMETHING interesting and evocative to make the audience think about your ritual in a critical manner.
  • You must offer some textual/verbal commentary on how this ritual has shaped you, affected you, diminished you, or troubled you, etc.
  • This is not a skit or a presentation! It requires a level of artistry – you are creating a performative commentary on your experience, so think outside the box and take creative risks in how you create your video.
  • Do not worry about a time or length requirement; it can be as short or long as you like as long as you are creative and critical with your work.

  • Post your video to VT as a new thread. Use the title, “EA 2 Ritual Video.”

To be clear—In your written report this time around, please focus on the Turner and Goffman readings and videos. But you may briefly reference any of the course materials for the week if they help you make a point you need to make. EA reports should be the result of concentrated application of course materials to a specific activity. The report simply illustrates that you understand how and why this activity is important to your growing knowledge of Performance, Language and Cultural Studies. If you ever doubt what you are doing with anything: 1) do not compare yourself to others in the class, and 2)everything you need is in the assignment and/or in the syllabus.

PROBLEM DESCRIPTION

• ➢ You are a geologist, working for a mining company that is mining a gold deposit in a saddle reef;
• ➢ The mine’s position is X 2601100 Y 5701030,
• ➢ but the reserves will be exhausted in the near future.
• ➢ Your predecessor in the position of a mining geologist left only an incomplete geological map.
• ➢ From this map it is obvious that the mineralization is restricted to a saddle reef in the hinge zone of a chevron fold anticline.
• ➢ The limbs of the anticline continue at least for half of their exposure distance towards the depth without changing into a syncline.
• ➢ The anticline is cut in the N by a shear zone.
• ➢ The offset is indicated by some sheared marker horizons and shown on the map.
• ➢ In the south the predecessor has mapped a normal fault, dipping to the NW, with a vertical offset of 100 m.
