This insurance focuses on alleged failure to perform on the part of, financial loss caused by, and error or omission in the service or product sold by the policyholder. These are causes for legal action that would not be covered by a more general liability insurance policy.

Professional malpractice insurance may take on different forms and names depending on the profession, especially medical and legal, and is sometimes required under contract by other businesses that are the beneficiaries of the advice or service.

William has been notified that he and Dr. Chen are being investigated for Medicare fraud due to fraudulent up charging of visits and documentation errors. One such case includes his visit with Charles. William no longer works at Highland Internal Medicine, having left the practice 18 months ago in 2019. William has also been notified by his State Board of Nursing that he is under investigation concerning fraud.

Highland Internal medicine used an outside company to help with billing and coding. William does have documentation through email that he agreed to this practice, and he checked the box for automatic update, waiving his right to review the coding before it was submitted for billing.

The billing and coding company went back and documented that William also saw Charles for and managed his chronic conditions at the visit on top of his annual Medicare wellness exam. William knows he did not cover or document on the management of these conditions as they were controlled or being managed by other specialists.

When we think of malpractice, we often think of harm to patients and not the other aspects of malpractice. Malpractice can include fraudulent billing. It is important to note if your malpractice policy covers fraud as not all liability insurances will cover fraud charges. In 2019, the Department of Justice found over $2.6 billion in health care fraud with $3.6 billion returned to the federal government between 2018 and 2019. There were 1,060 new criminal investigations in 2019 (Department of Justice, 2020, [PDF]).

It is key to make sure you are documenting accurately as well as checking any coding and billing you complete or that is completed on your behalf. Fraud charges can not only lead to financial risk but also detainment in a federal prison.

How does the mind perceive all the various objects of its knowledge?

1. THE FOUR WAYS OF PERCEIVING THINGS

There are four ways in which the mind knows things.

To know things by themselves.

We know things by themselves and without ideas when they are intelligible by themselves.

They can act on the mind and reveal themselves to it.

Understanding is a passive function of the soul, whereas activity (to simply be aware of a thing) is found only in the will.

The soul’s desires are not the true causes of ideas.

They are the occasional (or natural) causes of their presence as a result of the natural laws concerning the union of the soul with universal reason.

To know them through their ideas – through something different than themselves.

We know things through their ideas when they are not intelligible by themselves.

This could be because they are corporeal or because they cannot affect the mind or reveal themselves to it.

To know them through consciousness, or inner sensation.

Through consciousness we know everything that is not distinct from ourselves.

To know them through conjecture.

Through conjecture we know the things that are both different from ourselves and from things we know either in itself or through ideas.

E.g., Such as when we think one thing is similar to another thing we know.

2. HOW WE KNOW GOD

Though our knowledge of him is imperfect, God is the only thing we know through himself.

Because he is the only spiritual being that can act on our mind and reveal himself to it.

We perceive him through a direct and immediate perception.

God is immense, infinite, and without restriction – it is inconceivable that he is perceived through an idea (a particular being that is not universal or infinite).

Only God can enlighten out minds with his own substance.

Only god contains the intelligible world – where all things are located.

It is because of the union we have with him that we know anything in this life.

He enlightens our minds with his own being, and rules it without the mediation of any creature.

We can know corporeal things through their ideas (through God as only he contains the intelligible world – the source of the idea of all things).

Whilst it is possible to know things through God, it is not the case that we do.

We see in God only the things of which we have ideas.

There are things we perceive without ideas and know only through sensation.

3. HOW WE KNOW BODIES

Everything in the world we have knowledge of is either a mind or a body, or a property of a mind or a property of a body.

We know bodies with their properties through their ideas.

They are not intelligible by themselves, so we perceive them in that being that contains them in an intelligible way.

We have a perfect knowledge of bodies and their properties, because they are made intelligible to us through God.

We see their ideas through God.

When we see things as they are in God, we always see them in a perfect fashion.

The way we see things would be infinitely perfect if the mind seeing them were infinite.

The imperfection of our knowledge comes not from a shortcoming of the idea representing the body, but our mind considering/understanding it.

4. HOW WE KNOW OUR OWN SOUL

We don’t see the soul through ideas or through God, but only through consciousness.

Because of this, our knowledge of it is imperfect.

Our knowledge of the soul is limited to what we sense is taking place in us.

If we had never sensed things within us – e.g., pain, heat, light – we would be unable to know whether or not the soul was capable of sensing these things, because we do not know it through its idea.

But if we saw in God the idea corresponding to our soul, we would know, or at least know the properties of which it is capable.

As we know (or at least can know) all properties of which it is capable – because we know extension through its idea.

Through our consciousness or through the inner sensation we have of ourselves, we know that our soul is something of importance.

But what we know OF IT might be almost nothing compared to what it is in itself.

To know the soul perfectly, it is not enough to know only what we know through inner sensation.

As the understanding of the consciousness, we have of ourselves may just be the smallest part of our being.

Although we may have a more distinct understanding of the existence of our soul compared to the understanding of the existence of both our own body and those surrounding us, it is still evident that our knowledge of the soul’s nature is not as perfect as our knowledge of the nature of bodies.

This may be why people differ on their views of the soul.

Some say nothing is known better than the soul, others claim to know nothing less.

It may also prove that the ideas which represent to us external things are not modifications of our soul.

If the soul saw all things by considering its own modifications, it would have to know its own nature or essence more clearly than that of bodies – and all the sensations or modifications that it is capable of, more clearly than what the bodies’ is capable of.

The soul knows it is capable of a given sensation through experience – not the perception it has of itself (through consulting its own ideas).

We may not be able to tell if sensations such as colour and sound are modifications of the soul, but there is no figure that anyone, through the idea they have of extension, would not recognise as the modification of the body.

Modifications of the soul cannot be made known through definition,

Because we do not know the soul (nor its modifications) through ideas but only sensation.

And because such sensations are not attached to any words, we are unable to know them through any definition given of them.

E.g., pleasure, pain, or heat. They are not attached to any words – if someone that had never seen colour then felt heat, they would not know the sensation through definition.

Given that we have sensations because of our bodies (we feel through them), and that our bodies are not all disposed in the same ways, words used to define sensation can be open to interpretation.

It could be that the words used to express the modifications of our soul for one person can be the complete opposite of our intentions.

We can make people think bitterness when we intended to make them think of sweetness.

Although our knowledge of the soul is incomplete, what we do know of it (through consciousness or inner sensation) is enough to demonstrate its immortality, spirituality, freedom and several other attributes we need to know.

This seems to be why God does not cause us to know the soul, as he causes us to know bodies through its idea.

The knowledge that we have of the soul is imperfect, but it is not false.

On the other hand, the knowledge we have of bodies through consciousness or inner sensation is not only imperfect, but also false.

We need an idea of the body to correct our sensations of it, but we need no idea of our soul since our consciousness of it does not involve us in error.

Reason enables us to do this since our idea of the body reveals to us the modalities of which it is capable are quite different from those that we sense.

If we had any further knowledge of the soul – as clear as we do the body – it would lead us more to view the soul as separated from the body.

This would diminish the union between our soul and body by preventing us from regarding is as dispersed through all our members.

5. HOW WE KNOW OTHER MEN’S SOULS

It is only through conjecture that we have knowledge of the souls of other men and of pure intelligence.

We do not know other men’s souls either in themselves or through their ideas. They are also different from ourselves so we can’t know them through consciousness – meaning we must know them through conjecture.

We presume that the souls of other men are the same sort as our own.

We assume that they feel what we feel in ourselves, and even when these sensations have no relation to the body, we know we aren’t mistaken because we see in God certain ideas and immutable laws from which we know with certainty that God acts uniformly in all minds.

There are truths I know to be truth, and we are not mistaken in believing that others know these truths as well I do myself.

E.g., I love pleasure and good, and abhor pain and evil. All men have this inclination.

God will never make a mind that does not desire happiness.

We know this with certainty and evidence because it is God that teaches it to us.

Who else but God could reveal to us his designs and volitions?

When the body plays a part in what happens to us, we will almost always make a mistake in judging others in comparison to ourselves.

The knowledge we have of other men is liable to error if we judge them only by the sensations, we have of ourselves.

My passions will not be the same passions for someone else.

My perceptions will not always be perceived in the same way by someone else.

My sensations will not always feel the same to someone else.

It is an unsound argument that there are beings different to us and to God.

This reinforces the view that since all men have the same nature, we have the same ideas, because we all need to know the same things.[supanova_question]

I am not even certain how to grade this due to all the missing information and unrelated case law with limited descriiptions. The decisions made were not based on constitutional law. No case law supported the decisions and decisions were often absent of discussions about the rights of those involved in the issues. The score represents points for providing answers although the answers often represented general, unrelated information, that was not based on sound reasoning and application of the amendments that apply to public school personnel and students. Every company has one thing in common that they all need to be successful, and that is a code of ethics. Chapter 3.4 in our textbook discusses what ethics is, and how ethics plays a role in a business, and how managers and employees follow the rules and values. Ethics is important for businesses because it establishes that everyone in the company is clear on the common mission or goal, the same valuesm, and all of the guiding principles of the company. In a wall street journal article called “How Companies Can Create an Ethics Program for a New Era,” written by Alison Taylor, discusses how companies are revamping their ethics programs or starting one from scratch and how they are doing it.

Wall Street Journal author Alison Taylor starts off her article titled, How Companies Can Create an Ethics Program for a New Era, by comparing what was necessary of an organization’s ethics program in the past compared to what is expected of one today. In the past the only thing expected ethically of an organization was that it did not break the law. Taylor states that in today’s business climate an organization’s ethics program must include “boardroom diversity, supply-chain resilience, human-rights advocacy, carbon-emissions reduction, employee morale and motivation, and political lobbying” (2020, para. 2). Taylor further states that to encompass all of these issues organizations must rethink their current ethics programs and redesign them almost completely in order to avoid the risks of being judged unethically by one of the organization’s stakeholders (2020). An organization’s code of conduct has also evolved from a document that simply “outlined the rules that were necessary to legally comply with relevant regulations” (Taylor, 2020, para. 23), to require principles and voluntary commitments. Our textbook states that there are four ways for an organization to promote ethics, the third being to institute ethics codes. The textbook describes those as “a formal written set of ethical standards guiding an organization’s actions” (Kinicki & Williams, 2020, p. 97). Taylor agrees with this standard belief about ethics codes, but believes that organizations must go beyond the minimum to include things like principles and voluntary commitments.

The textbook’s third option to promote ethics is to include training programs. The textbook suggests these programs should include a case study approach to present ethical dilemmas to employees. Taylor agrees with this idea and believes ethical training programs should go beyond just stating the rules that cannot be violated. Taylor states that “ethics programs should provide senior and high-risk employees with tailored, scenario-based training (2020, para. 8). Taylor also says that the effectiveness of these programs should be measured, along with organizations evaluating how business goals are achieved, not just whether those goals are achieved (2020). By providing specific real world scenario training, and tying the use of the training into how organizations achieve goals, employees will begin to use ethical behaviors by default, and not just in order to be legally compliant.

Our textbook also states that another way for an organization to promote ethics is to create an ethical climate. The textbook states, “managers can promote ethical climates through the policies, procedures, and practices that are used on a daily basis” (Kinicki & Williams, 2020, p. 97). The daily basis part is key. If employees do not see consistent examples of ethical behavior by those in charge, then they will soon believe it is ok to be ethical only when it suits them. Taylor agrees with this sentiment by stating, “nothing degrades organizational culture faster than the perception that leaders evade accountability and operate with impunity” (2020, para. 17). Consistency of ethical behavior is also important because as stated by the textbook, “ethics needs to be an everyday affair, not a one time thing” (Kinicki & Williams, 2020, p. 97).

Our textbook discusses the challenge of ethical dilemma. Ethical dilemma is “a situation in which you have to decide whether to pursue a course of action that may benefit you or your organization but that is unethical or even illegal,” (Kinicki & Williams, 2020, p. 92). Taylor discusses the importance of considering what behavior you incentivize. Taylor states “Compliance programs will fail if employees are driven to meet unrealistic, short-term targets by any means necessary,” (2020, para. 10). This plays into the ethical dilemma discussed in the textbook. If compliance programs are setting unrealistic targets that are meant to be met by any means necessary, employees may face ethical dilemmas. If companies are incentivizing employees to meet these goals and are rewarding them no matter how they were met, employees may begin to choose to meet these targets in unethical or illegal ways in order to get the incentive. It is important for companies to be sure they are incentivizing only ethical behaviors in order to ensure employees will not face ethical dilemmas. Companies need to be well skilled in solving ethical dilemmas in order to avoid ethical or legal conflict.

Preparedness is about planning and being in a state where people are ready to respond to any kind of risk or disaster through means of arduous practice. Preparedness commonly refers to activities “undertaken prior to the onset of a disaster to enhance the response capacities of individuals and households, organizations, communities, states, and nations” (Phillips, Neal, & Webb, 2017, p. 140). There are organizations like the Red Cross who always make sure that those who are in danger of the hurricane season in Florida and other states are ready for what damage might pass through. When a devastating hurricane hurls through a community, the Red Cross and other organizations always have whatever services they need to set up, like shelters and food resources. Communities also prepare in situations where there might be danger. They prepare with stocking up from their local grocery store with supplies that people could use during an event such as a hurricane. Flashlights, food, bottled water, and many other items are examples of what they have on hand. Communities along a flood zone may stack sandbags around their properties to try and keep the water out for as long as possible. Neighborhoods where a wildfire is expected may soak the ground around their house to try and change the direction of the fire, so it does not head for their property. The preparedness of the federal, state, and local governments and individuals can help decrease the loss of life and property. Disaster preparedness is important at the individual, household, and community levels (Phillips, Neal, & Webb, 2017).

Being prepared may involve many different activities at different levels. Participating in neighborhood and community preparedness activities helps everyone when a disaster occurs. Individual and household preparedness activities include a checklist of actions that people take before disaster strikes. Examples may include purchasing food and water, learning first aid, storing a flashlight, radio, batteries and a first aid kit in a safe place, bracing furniture, installing shutters, and purchasing hazard-specific insurance. For organization preparedness activities, these checklists may include some of the same activities as household checklists, as well as talking to employees about disaster preparedness, conducting drills and exercises, developing relocation plans, and obtaining an emergency generator. If you lived along the coast and a hurricane was determined to make landfall around your house, you would take more preparedness steps than someone who lived inland and was not necessarily in the path of the hurricane. It also depends on the size and strength of the disaster.

Proverbs 27:1 says, “Do not boast about tomorrow, for you do not know what a day may bring” (English Standard Version). None of us know what tomorrow will bring except for God. There is no way we can fully be prepared for any and all events that we experience. However, we can take steps to be prepared for potential threats, such as maintaining extra supplies in your house, having a plan in place for when hurricanes, fires, or tornadoes occur. This could include a plan of where you are going to evacuate to and having the supplies to prepare your house such as wooden pallets to board up windows and doors.

The National Preparedness Goal, as mentioned on FEMA’s website, is “A secure and resilient nation with the capabilities required across the whole community to prevent, protect against, mitigate, respond to, and recover from the threats and hazards that pose the greatest risk” (FEMA, 2020). The Disaster Life Cycle involves four phases: mitigation, preparedness, response, and recovery. These four phases demonstrate the basis of what emergency managers do. The first phase, mitigation, involves steps that attempt to decrease the likelihood that a disaster would happen. According to (Phillips, Neal, & Webb, 2017), mitigation involves “activities that actually eliminate or reduce the probability of occurrence of a disaster, arms build-up, land-use management, establishing CEM (i.e., comprehensive emergency management) programs, building safety codes” (p. 75). Examples of mitigation may include zoning, floodplain protection, and enforcing building codes. The second phase, preparedness, are actions that are taken as a precautionary measure in the face of potential disasters.

As mentioned in our textbook, preparedness involves “activities that are necessary to the extent that mitigation measures have not, or cannot, prevent disasters … develop plans, mounting training exercises, installing warning systems, stockpiling food and medical supplies, mobilizing emergency personnel” (Phillips, Neal, & Webb, 2017, p. 75). Preparedness is an important phase because it involves the measures and steps that are taken to prepare and protect not only buildings, but communities and neighborhoods. An example I can provide involves my local community. I live in an area where we experience tornadoes every so often especially during certain months. When it nears that time frame, my community and local cities test our tornado sirens every Wednesday at 12pm to ensure they are working correctly and that they are heard, so if and/or when they need to be used and heard, they work and are successful at warning individuals of a possible nearby tornado.

This third phase, response, are the actions that are taken after a disaster has occurred. As defined in our textbook, response involves “activities that follow an emergency or disaster. Generally, they are designed to provide emergency assistance for casualties … seek to reduce the probability of secondary damage … and to speed recovery operations” (Phillips, Neal, & Webb, 2017, p. 75). Response is an extremely important step in the recovery process because it determines how the recovery is going to go. Examples of response may include search and rescue measures and emergency operations. Currently right now in Louisiana, response efforts will begin, if they have not already, as Hurricane Ida tore through the state and left a path of damage behind.  The last and final phase, recovery, are the efforts that are taken until life returns to normal. As defined by (Phillips, Neal, & Webb, 2017), recovery involves “activities that continue until all systems return to normal or better. Short-term recovery activities return vital life-support systems to minimum operating standards. Long-term recovery activities … return life to normal or improved levels” (p. 76). Examples of this phase may include restoring power, cleaning up the debris, and providing shelter for those who are in need. The disaster tradition is “grounded in disaster preparedness and especially disaster response activities” (Phillips, Neal, & Webb, 2017, p. 80). 2 Corinthians 4:8-9 says, “We are afflicted in every way, but not crushed; perplexed, but not driven to despair persecuted, but not forsaken; struck down, but not destroyed” (English Standard Version). In times of disaster, we must remember that no matter how bad the damage may be or hard the recovery may be, we are always able to overcome any and every thing as we always have God by our side.

Towards the of the 1970’s, President Jimmy Carter signed the Executive Order that established the Federal Emergency Management Agency (FEMA), effective April 1, 1979. Shortly after, President Carter signed another Executive Order that gave FEMA the dual mission of emergency management and civil defense (FEMA, 2021). FEMA is not only responsible for helping and assisting with natural disasters, but also helping with man-made disasters that lead to individuals needing assistance to recover. After the terrorist attacks of September 11, 2001, the United States government established anti-terror organizations through the development of Homeland Security. In 2002, President George W. Bush signed the Homeland Security Act, which lead to the development of the United States Department of Homeland Security (DHS). The Department of Homeland Security was created on March 1, 2003, and united FEMA and 21 other organizations (FEMA, 2021).  Homeland Security was established as a major part of the government to protect the United States from any and all threats, and to take action when action is needed. In 2005, Hurricane Katrina resulted in large-scale devastation along the Gulf Coast, as well as billions in losses to the economy. Congress passed the Post-Katrina Emergency Management Reform Act of 2006 which established FEMA as a distinct agency within the Department of Homeland Security, defined FEMA’s mission, and designated the FEMA Administrator as the principal advisor to the President, the Homeland Security Council, and the Secretary of Homeland Security for all matters relating to emergency management within the United States (FEMA, 2021). Emergency management is there when crisis occurs, and it involves agencies and departments that are there to help and assist those individuals and communities that have been impacted in some way. The field of emergency management is a rewarding, yet stressful field. Emergency management protects the public and ensures the safety of Americans. Natural hazards interest me because as they are natural, there is not necessarily a way of knowing exactly when a hurricane, earthquake, or tornado will occur. I grew up in Colorado where I experienced winter storms, tornados, and wildfires almost on a yearly basis. I have seen neighborhoods that have been completely destroyed from a fire or tornado but have seen the same neighborhoods grow and overcome the disaster.

            According to the Bible, “Fear not, for I am with you; be not dismayed, for I am your God; I will strengthen you, I will help you, I will uphold you with my righteous right hand” (Isiah 41:10, ESV). God will always be there, but we must remember he ultimately sends those willing to help. First responders are God’s servants who are here to jump into action and help those in need, and to assist with the recovery process in places where disasters have occurred.

The Drafting of the United States Constitution began in the 1700’s, it offically became signed into law on September 17th, 1787 it was ultimatley signed by delegates to the Constitutional Convention in Philadelphia. The U.S Constitution played the key role in establishing America’s national government and fundamental laws, it as well guaranteed certain basic rights to U.S citizens.

The possibility of amending the Constitution helped ensure its ratification, although many feared the powerful federal government it created would deprive them of their rights. To allay their anxieties, the framers promised that a Bill of Rights safeguarding individual liberties would be added following ratification.

The drafting of the U.S. Constitution was a major pivotal moment for American history. Framers drafted and adopted the U.S. Constitution when it then became clear that Articles of Confederation didn’t provide what the world needed which was a strong federal government, without that it posed quite the issue in post-revolutionary war America.

This PowerPoint will apply two theories of grief and loss in analyzing the ABC documentary Anh’s Brush with Fame that hosted Kurt Fearney. It will illustrate how psychodynamic theory and Dual process model can be identified and applicable in Kurt’s story and highlighting three components relevant to the narrative

Grief

According to Hall (2001) Grief is a response to loss in all its totality. It refers to the physical, emotional, cognitive, spiritual, and social experiences of loss. However, grief can be shown in a variety of ways that not only cause despair, but also can be used as a source of motivation to achieve things in life considered impossible. This will apply to Kurt Fearnley when looking at his narrative from the grief and loss theories psychodynamic theory and dual process model and apply a biopsychosocial assessment.

Kurt Fearnely

Kurt Fearnley was born without the lower portion of his spine. He grew up in a small town called Carcoar in NSW where he took up wheelchair racing in his teens. He is a three-time Paralympic gold medallist and has won marathons all around the world, including New York, London and Chicago marathons multiple times. He doesn’t now define his life by his disability, but uses it as motivation to conquer other goals that able body people have achived including crawling the Kokoda track and the Great Wall of China, as well as sailing with a winning Sydney to Hobart Yacht Race crew. A summary of the theories and components of a biopsychosocial assessment.

Psychodynamic theory

Psychodynamic theory is a theory of personality originated by Sigmund Freud. It describes human behaviour in terms of intrapsychic processes and the repetition of interpersonal patterns that are often outside of an individual’s conscious awareness and have their origins in childhood experiences. According to Freud, drives, that is, biologically based impulses that seek gratification, play a critical role in determining human behaviour. He viewed that the conflict between the drives id, ego, super ego are a necessary condition for development of civilization.

The ego performs functions that help the individual effectively adapt to reality, including the ability to accurately perceive the world, respond to both external and internal stimuli, and control the drives. The superego is a structure formed initially by the child’s internalization of parental ideals and prohibitions, which become transformed into abstract principles after the Oedipal period. The superego has four functions: providing direction (based on the ego-ideal), limiting behaviour, punishing unacceptable behaviour, and observing and measuring the ego against the ego ideal. If the individual successfully represses these wishes, they return to the unconscious. If repression is unsuccessful, the individual experiences anxiety, activating the ego’s defences, defined as “psychological activities that reduce the unpleasure of psychic conflict by blocking, inhibiting, or distorting awareness of disturbing mental contents (Holtz 2007)

i\In the context of mourning and Loss, Freud proposes that grief was the cognitive process through which loss was resolved. Freud suggests that in order for someone to recover from this loss, one needs to withdraw energy from the lost person or object and reinvest this energy in another person or object which involved some kind of action. In his initial work of his grief work process, he proposes that withdrawal has to be complete otherwise the person would suffer from pathological grief as opposed to normal grief (Goldsworthy, 2010)

Watching Kurt’s Narrative, one could identify elements mentioned in Freud’s Psychodynamic Theory. For example, Freud mentions the intrapsychic processes that people undergo and how ego manages to suppress the id drives. Even though it is not obviously mentioned one could image the initial conflict in the minds and lives of Kurt’s parents and siblings in trying to come to terms and accepting him as a member of their family. Some hints to this struggle is how his parents bring him home from hospital, rather than bring him during the day, they brought him home at midnight, and when his elder brother saw him, he said, “I don’t like it and asked his mum what it was, to suppress her frustrations her mum responded to him, “We gonna figure it out” which they did and treated him as an equal member of the family and society. Freud would point out that their decision to accept Kurt as a member of their family would be the work of the superego which always keep the id and ego at check underlining the ideal way of response and behaviour. We can also see a similar struggle in Kurt himself, even though he appeared strong and energetic, Freud would interpret the struggle to prove his ability as an ego trying to suppress the frustrations of the id Kurt, he successfully managed to suppress the id drive and become a recognized and accomplished athlete. As he shares in this interview Kurt acknowledges the fear that he might not make it but resolved not to fear “getting his hands dirty” and thus involved himself in practically every family life activity from swimming to climbing trees and playing Rugby league

DUAL PROCESS MODEL

This model was originated by Strobe & Schut in 1999. According to this model, the most effective adaptation is characterized by “oscillation” between two concurrent stressors and coping processes: loss-orientation and restoration-orientation.

This model encompasses individual ways of coping, different styles of grieving, periods of rest from grieving, and a biopsychosocial perspective. Loss-orientation refers to the concentration on and coping with the stress of the loss including grief related feelings and behaviors.

Restoration-coping refers to efforts to adjust to the changed circumstances, new roles and challenges, and attitudes of wellbeing. Where one orientation alone is emphasized, this can result in complicated grief responses.

Looking at this narrative with the lenses of Strobb and Schutt’s Dual Process model we could see how the Kurt and his family oscillated between the Loss orientation and Restoration-orientation. There were few implications for example I imagine before Kurt was born, his parents didn’t know their last born child will have a disability, neither did Kurt’s siblings, as Kurt mentioned, the doctors had suggested that Kurt would have been better in an institution rather than in a home, this must have been very hurtful for the parents, luckily they didn’t heed the doctors advice but decided to treat Kurt just like any other child and allowed him even to go to the local school something that Kurt looks back with appreciation. In these moments of struggle, Kurt’s parents and siblings experienced a loss orientation, but there were moments of restoration for both his parents, siblings, and Kurt himself. For example simple achievements like winning a green ribbon in high jump or crossing the finish line and winning gold medals or even finishing the Kokoda trail were all restoration orientations. But, as Strobb and Schutt point out this oscillation continues it is like in any life there are highs and lows. In low moments Kurt would experience self-doubts, for example his experience in high school, he shares he was terrified because he was in a different environment where none of them were family, he felt judged and different but when the pendulum of grief swung the other way from the support of his teacher Mrs Dicko, a ray of hope emerged, it was a similar feeling when he was supported when saw over five hundred athletes all in wheelchairs. in his own words he says, “I met normality, I am not fragile, I am strong, I am valued” these high moments would be the restoration coping moments, among the highlights of such moments is how Kurt describes the race in NY especially how he says about his son, “he will never remember it, I will never forget it”

Despite looking at his disability from a positive perspective there are momnets where Kurt still experiences grief and loss. There are moments he looks back with regret like missed opportunities such as being able to scram like his brothers could and probably always struggling to prove himself as his statement after winning the Athens marathon “as long as mum and dad can look at me with pride, I am ok. however, his self-awareness doesn’t take away his confidence for he says, “disability isn’t ugly, not fragile but a path of human experience”.

THE BIOPSYCHOSOCIAL ASSESSMENT RELEVANT TO THE NARRATIVE

PHYSICAL

Kurt was born with sacral agenesis, a congenital disorder that resulted in his lower limbs disability, in the interview he narrates that they had to break both of his legs to facilitate his birth. At birth the doctors didn’t believe he would last longer than a week this precipitated his parents to name him early before anything could happen.

SOCIAL

Kurt comes from an average family, the youngest of five children. He grew up on a farm in a small country town called Carcoar with a population of 200 people at the time. With the support of his family, this community was very supportive of Kurt, he mentioned how he was embraced by everyone and treated just like everyone else which helped with being able to adjust to his disability and look for opportunities to be part of the community. His social supports are strong for Kurt which are demonstrated in the community coming together to raise funds to facilitate his first trip to USA for a wheelchair basketball competition. However from a social perspective his disability cause some mental issues for example, the challenges he first faced in high school where he felt different and judged by how his fellow students through the looks given to him. But again it was the social support displayed by one of his high school teachers who would introduce him to sport and as a result change the outlook of his life. She was able to use her role as a school teacher to educate other children about disability and the way we should treat them by organising for over 20 wheel chairs to be given to the school in which facilitated all able bodied students compete with him in playing basketball. From this point his social dimensions improved and used this as an opportunity to create goals for himself that would make him a role model to other children in years to come as a Para-olympian and inspirational speaker.

PSYCHOLOGICAL

Despite his physical disability Kurt is a very balanced person with a positive attitude towards life. His confidence made him attempt to lead an ordinary life and participate in every sphere of life from his early childhood. However this has not always been the case as he experienced time where he had low self-esteem and self-worth especially when having to attend a bigger school at high school and interact with students that were outside his small town. He expressed feeling different and for the first time felt that his appearance was gong to impact his way of life.

his conviction that disability is not fragile nor was it ugly or broken part of life has made him push himself without fearing to make his “hands dirty’ a drive that has seen him be a renown athlete with many awards and even earned him a place to dine with royalty.

Social work implications

In Summary Kurt teaches us that disability is in deed not in ability a lesson that we social workers should learn and become advocates borrowing a leaf from his family, the principal of his primary school, Mrs Dickson and the whole community of Crcoar to be more appreciative supportive and inclusive of people with disability.

Michael Bond lives a quiet, uncomplicated life in Goedken, California. Michael is an accounting assistant practicing in a small accounting firm. Michael has one daughter, namely Meredith, who is three years old. Michael’s spouse, and the mother of Meredith, died in an automobile accident when Meredith was 18 months old. Michael has two children from a prior marriage, and who live with their mother in a large, Eastern metropolitan community. Michael sees his two children occasionally throughout the school year, and has extended summer visitation with them. Michael Bond has modest wealth, consisting mainly of life insurance and retirement benefits. They have no significant health problems. Michael’s Last Will and Testament is set out below.

Your assignment:

Identify and discuss the use and value of wills in an estate plan (generally) and responses that explain the following provisions of the Will of Michael Bond set out below. In your descriiption, explain the provisions and the intended/expected results when Mr. Bond dies, and any contingencies. I, MICHAEL JOSEPH BOND, of Goedken, Iowa make this my will and revoke all prior wills and codicils.

FIRST: My executor shall pay all expenses of my last illness and funeral, costs of administration including ancillary, costs of safeguarding and delivering legacies, and other proper charges against my estate (excluding debts secured by real property or life insurance). My executor shall also pay all estate and inheritance taxes assessed by reason of my death, except that the amount, if any, by which the estate and inheritance taxes shall be increased as a result of the inclusion of property in which I may have a qualifying income interest for life or over which I may have a power of appointment shall be paid by the person holding or receiving that property. Interest and penalties concerning any tax shall be paid and charged in the same manner as the tax. I waive for my estate all rights of apportionment or reimbursement for any payments made pursuant to this article.

My executor’s selection of assets to be sold to make the foregoing payments or to satisfy any pecuniary legacies, and the tax effects thereof, shall not be subject to question by any beneficiary.

My executor shall make such elections and allocations under the tax laws as my executor deems advisable, without regard to the relative interests of the beneficiaries and without liability to any person. No adjustment shall be made between principal and income or in the relative interests of the beneficiaries to compensate for the effect of elections or allocations under the tax laws made by my executor or by the trustee.

The balance of my estate which remains after the foregoing payments have been made or provided for shall be disposed of as hereinafter provided.

SECOND:I have no spouse living. I have two natural children now living from my first marriage, namely:

FOURTH:All the residue of my estate, wherever situated, including lapsed legacies, but expressly excluding any property over which I may have power of appointment at my death, I give to JOHN BOND of Laz, California, as trustee, to be held and disposed of as provided for below:

SECTION 1:Until the time hereinafter fixed for distribution, the trustee may pay so much or all of the income and principal of the trust estate to any one or more of my children and the descendants of a deceased child of mine from time to time living, in equal or unequal proportions and at such times as the trustee deems best, considering the needs, other income and means of support, and best interests of my children and those descendants, individually and as a group, and any other circumstances and factors which the trustee deems pertinent, adding to principal any income not so paid. No payment of income or principal to a child or other descendant of mine shall be charged against the share hereinafter provided for the child or descendant or hi

SECTION 2:If upon or whenever after my death there is no living child of mine under the age of 24 years, the trustee shall distribute the trust estate in equal shares to such of my children as shall then be living, except that the then living descendants of a deceased child of mine shall take per stirpes the share which the child would have received if living, subject to postponement of possession of provided below.

SECTION 4:Each share of the trust estate which is distributable to a beneficiary who has not reached the age of 21 years shall immediately vest in the beneficiary, but the trustee shall (a) establish with the share a custodianship for the beneficiary under a Uniform Transfers or Gifts to Minors Act, or (b) retain possession of the share as a separate trust, paying to or for the benefit of the beneficiary so much or all of the income and principal of the share as the trustee deems necessary or advisable from time to time for his or her health, maintenance in reasonable comfort, education (including postgraduate) and best interests, adding to principal any income not so paid, and distributing the share to the beneficiary when he or she reaches the age of 21 years or to the estate of the beneficiary if he or she dies before receiving the share in full.
SECTION 5: My trustee shall have all the rights, powers and responsibilities as set out the applicable Iowa Probate Code provisions as they may apply to trustees. In addition to those powers, and without limiting the powers, my trustee shall have the following powers:

The trustee shall hold, manage, care for and protect the trust property and shall have the following powers and, except to the extent inconsistent herewith, those now or hereafter conferred by law:

a) To retain any property (including stock of any corporate trustee hereunder or a parent or affiliate company) originally constituting the trust or subsequently added thereto, and to invest and reinvest the trust property in bonds, stocks, mortgages, notes, bank deposits, options, futures, limited partnership interests, shares of registered investment companies and real estate investment trusts, or other property of any kind, real or personal, domestic or foreign; the trustee may retain or make any investment without liability, even though it is not of a type, quality, marketability or diversification considered proper for trust investments;
b) To cause any property, real or personal, belonging to the trust to be held or registered in the trustee’s name or in the name of a nominee or in such other form as the trustee deems best without disclosing the trust relationship;
c) To vote in person or by general or limited proxy, or refrain from voting, any corporate securities for any purpose, except that any security as to which the trustee’s possession of voting discretion would subject the issuing company or the trustee to any law, rule or regulation adversely affecting either the company or the trustee’s ability to retain or vote company securities, shall be voted as directed by the beneficiaries then entitled to receive or have the benefit of the income from the trust; to exercise or sell any subscriiption or conversion rights; to consent to and join in or oppose any voting trusts, reorganizations, consolidations, mergers, foreclosures and liquidations and in connection therewith to deposit securities and accept and hold other property received therefor;
d) To lease trust property for any period of time though commencing in the future or extending beyond the term of the trust;
e) To borrow money from any lender, extend or renew any existing indebtedness and mortgage or pledge any property in the trust;
f) To sell at public or private sale, contract to sell, convey, exchange, transfer and otherwise deal with the trust property and any reinvestments thereof, and to sell covered call options, from time to time for such price and upon such terms as the trustee sees fit;
g) To employ agents, attorneys and proxies and to delegate to them such powers as the trustee considers desirable;
h) To compromise, contest, prosecute or abandon claims in favor of or against the trust;
i)To distribute income and principal in cash or in kind, or partly in each, and to allocate or distribute undivided interests or different assets or disproportionate interests in assets, and no adjustment shall be made to compensate for a disproportionate allocation of unrealized gain for federal income tax purposes; to value the trust property and to sell any part or all thereof in order to make allocation or distribution; no action taken by the trustee pursuant to this paragraph shall be subject to question by any beneficiary;
j)To deal with, purchase assets from, or make loans to, the fiduciary of any trust made by me or a trust or estate in which any beneficiary under this will has an interest, though a trustee hereunder is the fiduciary, and to retain any assets or loans so acquired, although not of a type, quality, marketability or diversification considered proper for trust investments; to deal with a corporate trustee hereunder individually or a parent or affiliate company;
k) To determine in cases not covered by statute the allocation of receipts and disbursements between income and principal, except that (i) if the trust is beneficiary or owner of an individual account on any employee benefit plan or individual retirement plan, income earned after death in the account shall be income of the trust, and if the trustee is required to pay all trust income to a beneficiary, the trustee shall collect and pay the income of the account to the beneficiary at least quarterly (and to the extent that all income cannot be collected from the account, the deficiency shall be paid from the principal of the trust), and (ii) reserves for depreciation shall be established out of income only to the extent that the trustee determines that readily marketable assets in the principal of the trust will be insufficient for any renovation, major repair, improvement or replacement of trust property which the trustee deems advisable;
l)To elect, pursuant to the terms of any employee benefit plan, individual retirement plan or insurance contract, the mode of distribution of the proceeds thereof, and no adjustment shall be made in the interests of the beneficiaries to compensate for the effect of the election;
m)To take such action in collecting the proceeds of any life insurance policy payable to the trustee (after deducting all charges by way of advances, loans or otherwise, for which the trustee shall not seek reimbursement) as the trustee deems best, paying the expense thereof from the trust property, but the trustee need not enter into or maintain litigation to enforce payment on a policy until indemnified to its satisfaction against all expenses and liabilities which might result therefrom; the insurance company shall not take notice of the provisions of this will or see to the application of the proceeds, and the trustee’s receipt to the insurance company shall be a complete release for any payment made;

n) To inspect and monitor businesses and real property (whether held directly or through a partnership, corporation, trust or other entity) for environmental conditions or possible violations of environmental laws; to remediate environmentally-damaged property or to take steps to prevent environmental damage in the future, even if no action by public or private parties is currently pending or threatened; to abandon or refuse to accept property which may have environmental damage; the trustee may expend trust property to do the foregoing, and no action or failure to act by the trustee pursuant to this paragraph shall be subject to question by any beneficiary; and
o) To perform other acts necessary or appropriate for the proper administration of the trust, execute and deliver necessary instruments and give full receipts and discharges.

In the wake of increased terrorism globally, several questions and debates surround the implications of Muslims as terrorists, given the increased racial profiling in determining terrorist suspects. Religion plays an integral role within the confines of terrorism, influencing the different backgrounds that try to explain different backgrounds and differences within issues pertinent to terrorism. Various issues act as drivers of terrorism; therefore, relying on religion as the sole criteria upon which suspects aiming to conduct terrorism are defined. The general implication that portrays Muslims as terrorists is quite unfair to the religion since it violates their rights and goes against humanity. Despite the continuous calls for the world and stakeholders involved in the security sector to not perceive Muslims as terrorists, the element has spread and remained substantially high, which calls for more enactment of frameworks to control and mitigate the concern.
Religious terrorist Concept 

Over time, the Muslim community has been subjected to illegal searches, which have nullified their dignity and respect, perceiving them as a more violent community that is associated with terror, which is not the case. Considering the activities of the security agencies, more so the FBI, which are concerned with the security scrutiny of things, the prejudice against Islam-affiliated individuals is evident, even though almost all of them are law-abiding. The concern has recently escalated, which has led to the Islam community suing the FBI on issues related to unlawful surveillance. The agency has been secretly engaging in unlawful searches and surveillance on the Muslim fraternity, increasing injustice and defying their privacy and dignity. The agencies even give them the go-ahead to use detectives amongst themselves, which has raised questions about their rights and freedoms in a country that is supposed to protect them from terrors and other forms of prejudice. The recent attacks witnessed worldwide have been catastrophic in terms of the consequences that call for tightening of the belt in scrutinizing the populace to prevent the attacks. However, it is essential for the authorities not to disregard the practices and engage in more comprehensive and law-abiding policies to harness their evidence rather than harassing law-abiding citizens in the name of suspicion, which is barely based on the religion of an individual (Pilkington, 2021). Given its reliance on major problems that occur in daily activities, its connection with Islamic religion does not prove its reliance on terrorism.
Factors Driving the Perception of Muslim as Terrorists

Various concerns and factors have become the driving factors and catalysts for Muslims to be labeled as terrorists, and this situation has increased in the past few decades. Although there are several international terrorist organizations based on the Islam, measures need to be taken to contain and control this problem. After many attacks and war activities, activities with serious consequences in the United States have increased, such as the 9/11 attacks, which changed the public view on Muslims
Racial Profiling

Ethnic profiling has been rampant over the years, which has led to wrongly arrests of people who have committed no crime making it relatively ineffective and violative. It is based upon the assumptions that individuals belonging to certain races, ethnic backgrounds, and other factors such as religion implicate the law enforcement agencies to develop the analogy that the individual is a terrorist even in the absence of substantial evidence. The method is based on the bias factors established by minimal evidence, which is usually useless. The criticality of the security sector around the globe creates the notion that no chances should be taken in security issues given the costs that would be implicated on a country in the case of such a catastrophe. The need and desire to eliminate such threats to the jurisdictions is primary and should enable the oversight and laying of more substantive and robust frameworks that will be intensive and evidence-based rather than focusing on the religious aspect, which has shown the non-reliability of the profiling. The blame of the issue lies barely with several stakeholders in the globe, including governments and other lawmakers who have made fewer steps in its elimination. The USA, for instance, has overseen the increased profiling under several regimes that violated the rights of its citizens who belong to the Muslim community. Basing their actions on the national security aspect, the profiling aspect has proven to have more disadvantages as contrasted to advantages postulating the avenue to decrease the application and instated apply more due diligence in the security frisking to move away from the utilization of religion as a medium to prove an individual as Muslim. 

Although the continuous calls to the representatives and the judiciary have been ignored, the matter going ahead to carry out their activities implicates its citizens’ religious aspects. Given that the Muslim fraternity in the USA is projected to increase to almost 2% by 2050, there is a need to recognize the diversity aspect to allow for inclusion and more diverseness within the country (Eckart, 2021).  The growing Muslim community in the USA should act as a wake-up call to reduce the practice among the individuals to be recognized as law-abiding citizens. The elimination of religion as a criterion for determining terrorists is poor and should be replaced by more surveillance activities to assess the actual course of individuals. Ensuring that law enforcement officers rely on factual information and evidence and eliminating the dependency on assumptions founded upon the religious line will be paramount for them to stop the concern. Between 2001-2009, the FBI indicates that it wrongly incarcerated 1500 Muslims, which is a disturbing element that has created a massive divide and disturbance within the social confines of society (GOITEIN & PATEL, 2021). It is appalling that racial profiling still exists, making an unfair society that punishes persons grounded on their contextual elements and heritage, such as being a Muslim. 

Furthermore, terrorists hail from various diverse backgrounds, which is a factor that needs to sink in among the police officers and other legal officers to avoid the bias and compromise that arises from religious profiling, which may be ineffectual. Considering the NYPD’s continuous raiding of mosques where it has seen various searches and infiltration activities, no evidence led to the arraignment of substantial evidence, which led to findings that could prove successful (Considine, 2017). Islam is a religion just like any other. It is built along with its firm foundations that create a more comprehensive background in their morality and well-being, further showing its role in upholding peace.   
Islamophobia

The prevalence of the issue between the citizens and societies has ensued over the years and is only expanding rapidly. Partly recognized as a specialty of racism in society, there has been a need to create an integrative community that will allow people to embrace society to reduce the anxiety and tension as well as prejudice in the populace. Islamophobia is described as the spread and exaggeration, which exists within the Islam allowing prevalence of hate, tension, and prejudice in the interaction of the Muslim community. The scope and existence of the issue within the communities are unfounded, given that there is no need to develop fear and anxiety when dealing with people who have no ill motive against persons. The primary drivers of the issue are concerned with the prevalence of the Islam fraternity in terror attacks. Dating back from the 911 attack, which occurred in the country, caused huge concerns among the authorities and populace, leading to various theories about the increased involvement of Islam in terrorist activities.

Various Islamic organizations are conducting and claiming various attacks around the world, which has led to prejudice and hatred within the general public given that they are commonly perceived as violent and against humanity. The hatred has been evident in The USA given the recent ban of Muslim travel during the Trump administration, which was highly revolted given the generalization of Muslims as potential terror suspects out of line (The Chicago Reporter, 2021). Despite the current regime enacting the framework which allowed for Muslim travel again, the hatred and prejudice have developed more and more, which is evident in the public image where even politicians have continuously engaged their colleagues affiliated with the religion. 

An inquiry in the country shows that only a third of Americans perceive Muslim Americans to be loyal to the country, which creates rifts within the populace concerning their subjection to violation and inhumane practice (Gallup, 2021). The involvement of the American military in the Islamic countries, which has seen considerable ramifications in terms of deaths of soldiers and other American personnel, has increased more rooting for Islamophobia, creating a firm foundation for the issue. 57% of individuals have postulated that they bear negative perceptions of the Islamic countries, characterizing them as violent and inhumane due to the housing of significant terror organizations worldwide (Gallup, 2021). Additionally, the composition of the terror organizations that have seen the increased engagement of the Muslims in war-related issues such as the attack on the US ambassador to Libya has increased the prevalence among the populace. Even though there is damning evidence on the inclusion of Muslims in the terror activities around the world, there is a need to eliminate the assumption which assumes generalization of all Muslims as terror suspects. By virtue that aligns with a country’s citizenship, when Muslims gain the ideals upon which America is built upon hance seek to implement their loyalty to the country even more as they continue with their endeavors, thus no implication of them engaging in insecurity attacks. 
Mitigating the issue

There is a need to create a coherent approach to install shrewd policies meant to protect the Muslim community from perceiving them as Muslims. The generalization theory that the majority of the individuals have adopted that has seen the widespread regard of religion to be associated with terror is quite unfortunate. There is a need to reason and develop relevant rationale meant to derive the real implication of religion on societal issues. Islam is similar to Christianity, given that they define a particular course since it is established along the confines of goodwill regarding Christianity allowing individuals to engage in matters that allow them to show a decent life that preserves humanity. 
The USA government is making immense steps in reducing the perceptions by enacting regulations and amendments meant to reduce the perception of Muslims as a terror religion. The regulations play an integral role in developing and allowing the populace to treat the religions equally and with dignity since anyone can be involved in such activities given that a range of issues influences them. Respecting Islam is a crucial aspect that should be enacted by sharing the ideals upon which the religion’s teaching postulate allowing the public to capture the implication of the faith in their lives. Americans should be well aware of the sharia laws and allow interactive sessions to increase its prevalence. Introducing religion in learning institutions would be impactful since it would enable children to learn about different religions and what they entail, thus reducing prejudice and discrimination. Recently the efforts within the judicial system have seemed to work in favor of the Muslim community given the recent encounters. An FBI personnel who engaged in coercive measures that involved intimidating and harassing the Muslim community was recently put behind bars furthering the need for equality and a society where racial profiling is not applicable (Al-Arian, 2021). The generalization aspect which prevails among the populace characterizing every Muslim as a suspect is quite unfortunate. 

Given that there are countries whose percentages in terms of their faith have a high prevalence of Muslims but still enjoy peaceful correlations with minimal conflicts, it is proof that the Muslims are even better regarding and wanting peace. Currently, there are several lawsuits against security agencies in the USA, which will help create a concisive direction in upholding their human rights and reducing Islamic profiling. Further to this, the recent military withdrawal in countries such as Afghanistan, which is highly classified as a Muslim society, will contribute to the factor. The majority of the attacks that happen are based on retaliation to various actions within the warfare fraternity. By the forces living in the country, reducing such wars will reduce the conflicts and the development of theories based on Islamic profiling. In conclusion of the mitigating factors, the judicial systems will have a substantial role in creating a more cohesive approach by advocating for the civil liberties of the Muslim culture, assuming that the safety agencies have posed for a lengthy duration, quoting national security worries at the cost of the human rights and liberties of Muslims. 
Conclusion

Profiling based on religious backgrounds is unacceptable within the law enforcement agencies, which has seen wrongful convictions accompanied by violation of the human rights of the Muslim community. Driven by Islamophobia and racial profiling, the generalization and link of Muslims with extremism is quite unfortunate since it is a religion like any other that upholds its doctrines and foundations, maintaining peaceful correlations. The profiling of individuals based on their religion has seen immense disregard for their rights where they have been treated inhumanely due to the perceptions that they may engage in terrorists’ activities. The fact that they have acquired citizenship in the country allows them to abide by the laws and ensure peaceful relations by avoiding any wrongdoing associated with terrorism. The perception and linkage of Islam with terrorism have increased over time. There is a need to engage relevant stakeholders to ensure the issue is highlighted and addressed by the implementation of ideal frameworks which will allow de-linking the religion with terrorism.

George is also actively involved in his teenage son’s basketball league, coaching regularly for their team. Recently, George has experienced muscle weakness and unresponsive muscle coordination. He was forced to seek medical attention after he fell and injured his hip. After an examination at the local hospital following his fall, the attending physician suspected that George may be showing early symptoms for amyotrophic lateral sclerosis (ALS), a degenerative disease affecting the nerve cells in the brain and spinal cord. The week following the initial examination, further testing revealed a positive diagnosis of ALS.

ALS is progressive and gradually causes motor neuron deterioration and muscle atrophy to the point of complete muscle control loss. There is currently no cure for ALS, and the median life expectancy is between 3 and 4 years, though it is not uncommon for some to live 10 or more years. The progressive muscle atrophy and deterioration of motor neurons leads to the loss of the ability to speak, move, eat, and breathe. However, sight, touch, hearing, taste, and smell are not affected. Patients will be wheelchair bound and eventually need permanent ventilator support to assist with breathing.

George and his family are devastated by the diagnosis. George knows that treatment options only attempt to slow down the degeneration, but the symptoms will eventually come. He will eventually be wheelchair bound and be unable to move, eat, speak, or even breathe on his own.

In contemplating his future life with ALS, George begins to dread the prospect of losing his mobility and even speech. During the last session, we looked at what principles and ideas need to be considered as we look at the emerging issues that face us in an increasingly digital world. During the 2 weeks of this session, we will take a much deeper look at when, why, and how we, individually and collectively, interact with technology.

One-to-one laptop programs are probably the most public example of humans interacting with technology in education. Many perspectives have emerged about the benefits and drawbacks of every student having his or her own laptop for learning. As influencers in this field, we need to be able to respond to these concerns and advocate for individuals using technology, when appropriate. Student use of digital devices continues to be a major discussion point, especially as most or all K-12 schools went to an online environment of some sort during the COVID-19 pandemic. Of course, students weren’t the only ones working from home. Guiding questions: Should schools be 1:1, and if so, what should that look like? Bring your own device? Chromebooks? iPads? Phones? Should students take them home or leave them in school?

Way before the digital landscape changed due to COVID-19, it was important to examine the ways in which humans interact with technology. In this course, we want to think critically about the related literature that exists and make critical judgments and predictions as to what roles technology can and should play in our lives now and in the future. Guiding questions: What are some of the most significant issues related to technology use? Social isolation? Attention and learning concerns? Technology addiction? Individual access? Accessibility for individuals with disabilities? Do some of these issues disproportionately affect specific student or population groups? What about the future of work? We’ll watch a video from the World Economic Forum about what future work skills are needed and what jobs we may lose to automation. Your discussion post will focus on one of these issues using Flipgrid, which emerged as an online video discussion tool in 2014. Considering how disruptive COVID-19 was, we will take a closer look at how various fields were affected. We’ll do this through a collaborative group jigsaw activity, using the resources you accumulated in the repository in the last session.

Chapter 5 continues this idea and includes information about blogging. The Hadlington et al. (2019) article is an interesting look, through focus groups, at the effects that technology, specifically tablets, has on young children in their homes. The article by Imbriale et al. (2017) describes the 1:1 device journey in a local school district. James et al. (2017) also look at youth and technology but specifically identify the “known impacts and research gaps” related to digital life. To define the performance of such bearings, tribology comes into play. Tribology is the study of friction, lubrication and wear of two mating surfaces in relative motion. Dr. H. Peter Jost coined the term “tribology” in 1966 in “The Jost Report” from the Greek words “tribo” meaning to rub and “ology” the study of but the field is not new; it was known to Egyptians in 2400 BC. Egyptians used tribology by pouring lubricant in the transport of the stature of Ti from a tomb at Saqqara, Egypt to reduce the friction or perhaps to reduce manpower. Leonardo Da Vinci, a more famous tribologist talked about many different tribological configurations. Based on his study, several ASTM standards have been generated. There are many disciplines to tribology like biomedical tribology, biotribology, classical tribology, food tribology, geotribology, green tribology, mechanical tribology, micro/nanotribology, tribotronics, computational tribology, space tribology and open system tribology. People experience this phenomenon every day such as tyres and brakes in automobiles, hairstyling, cosmetics, even when brushing their teeth, eating or charging their phones. Improved tribological knowledge has the potential to save a lot of money to industries. Better implementation of tribological principles and practices could save industries >£515 million per year according to “The Jost Report”, provided to the British Parliament – Ministry for Education and Science (Satyendra, 2015). This is accomplished by the use of innovative materials, new lubricants and novel component designs. The main challenge to tribology is in ensuring that testing and modelling are appropriate to the right mechanism in the tribological contact which can then be used in designing bearings. Machine failure is usually due to wear than component breakage in most cases. Wear is a feature of an engineering method rather than a material’s intrinsic property. As engineers seek to reduce energy losses in machines and in their frictional components, bearings, which are tribological in nature, therefore, will need to have lower friction, improved lubrication and be reliable and longer lasting. The need to reduce wear has prompted the creation of new wear-resistant material, drawing the attention of maintenance engineers all around the world. Destination country: The United States presents many opportunities for illegal marketplaces because there is such a huge demand for illicit goods and services. Many multi-billion dollar companies based in the country receive and supply a wealth of information on their clients or consumers, which is just the information we look for. Mainly, we want to target healthcare providers, such as UPMC, because of their abundance of personal information access, such as credit card information and social security numbers. We also find that healthcare providers have become more vulnerable to cyber attacks because of their fragility due to the pandemic. Our success in retaining this information solely depends on our ability to hack and launder it, which is becoming increasingly difficult with greater cybersecurity measures being implemented. Additionally, the United States is full of people who lack general online safety awareness, which makes it easy for our organization to steal their information directly. The only limit on the supply of information is the

ability for our organization to recruit skilled individuals and successfully design and implement hacking and cybersecurity operations, which has proven to be increasingly more challenging (but not wholly unprofitable) in recent years.
Like the Chinese Triads, our organized crime group is not highly organized and is made of independent groups or cells that have similar structures. Members within the group hold different roles and are advanced in different aspects of criminal activity. In this organized crime group, there is no hierarchical structure, meaning nobody is vertically “above” one another. We chose this structure because we did not want one main leader and instead wanted everyone to use their strengths to lead their own “cell.” The decentralized, loose structure of the Triads was most appealing and relatable to our organization’s activities and goals, and advantageous in the case of avoiding detection and prosecution by law enforcement in either Venezuela or the United States. Some “cell” members may have slightly different motivations and skills, but all are committed to the aims and advantages of associational membership with our organization.

The 2010 Chilean Mining Rescue (A)

On August 5, 2010, 700,000 tons of some of the hardest rock in the world collapsed in Chile’s century-old San Jose? mine. The collapse buried 33 miners at a depth almost twice the height of the Empire State Building—over 600 meters (2,000 feet) below ground. Never had a recovery been attempted at such depths, let alone in the face of challenges like those posed by the San Jose? mine: unstable terrain, rock so hard it defied ordinary drill bits, severely limited time, and the potentially incapacitating fear that plagued the buried miners. Could the trapped miners and rescue workers mobilize before air and resources were depleted? The ensuing efforts would draw the attention and resources of countless people in Chile and around the world—and theirs would become a story of human survival, ingenuity, and hope facing the most desperate of circumstances.

The Mining Industry of Chile

With volcanoes, glaciers, deserts, and an immense continental mountain range, the geographically varied country of Chile extends along more than half of the Pacific coast of South America. Often referred to as the mining capital of the world, Chile was the world’s largest producer of copper, accounting in 2009 for about 35% of the world’s copper production. Copper was also a pillar of Chile’s economy, contributing 14.4% of the country’s GDP in 2010.1

Much of Chilean copper production lay in the hands of international investors until the 1950s, when the Chilean government, under President Carlos Iba?n?ez del Campo, initiated a nationalization process that succeeding governments continued. Through negotiations with foreign investors, the government gradually acquired control of Chile’s largest copper mines. Even after General Augusto Pinochet’s junta seized control of the government in 1973 and began to implement reforms that favored the free market, the mines remained in government possession.2

Codelco

The National Copper Corporation of Chile (known by its Spanish acronym, Codelco) was established in 1976. With control of Chile’s largest mines, Codelco became the largest copper- producing company in the world and in 2010 accounted for 12.5% of total global copper production.3 With annual revenues of over US$12 billion in 2009 alone, Codelco also constituted a major source of income for the Chilean government, which played a key role in the company’s foremost decisions. The president of Chile appointed Codelco’s board of directors, and Codelco’s president was Chile’s Minister of Mining.4 Shortly after the San Jose? mining accident in August 2010, Chilean President Sebastian Pin?era placed Codelco in charge of the response.

Despite the dominant size of Codelco, many of the world’s private mining companies (including Canada’s Barrick Gold Corporation, the United Kingdom’s Antofagasta plc, BHP Billiton of Australia and the United Kingdom, and Phelps Dodge Corporation of the United States) remained major investors in Chile’s mining sector. In 2010, the Escondida mine, with a 57% controlling ownership interest by BHP Billiton,5 produced about 7% of global copper production, making it the world’s largest single-mine producer of copper.6 Many of these private companies would self-mobilize their resources in the wake of the 2010 mining accident.

Safety Practices

With an industry average of 34 deaths per year since 20007 and countless day-to-day injuries, work in Chilean mines was risky. It demanded employees to drive truckloads of mining explosives across an earthquake-prone region.8 Job-site safety practices, however, remained highly variable across mining companies in Chile, and a number of mines, such as the San Jose? mine, were known for emphasizing production over safety.9

The San Jose? Mine

In 2010, Compan?i?a Minera San Esteban Primera owned the San Jose? mine. Located in the mineral- rich Atacama Region of Chile (see Exhibit 1), the San Jose? mine had been operational since 1889.10 The inside of the mine included long, sloping tunnels that spiraled over 16 kilometers, reaching a depth of over 700 meters (see Exhibit 2). The mine produced roughly 2,700 kilograms of copper daily (US$22,000) and boasted gold reserves worth almost a billion dollars (at 2010 prices).11

In the last decade alone, accidents at the mine had repeatedly brought the operations under scrutiny. In 2007, the death of a geologist during a mine accident led to a total shutdown. Many safety procedures, however, remained negligent even after the mine was reopened in 2008.12 Outdated maps, missing escape ladders in ventilation shafts, and the absence of backup exits13 made the mine an extremely dangerous work site. One of the miners lost a leg in an accident in July 2010.14

Many miners at San Jose? wondered why the mine had not already collapsed, given a century’s worth of disorganized dynamiting, drilling, and extractions that had diminished the mine’s support structure. Inside San Jose? (as in most deep mines), hot, humid conditions were common, with temperatures usually over 32° Celsius (90° Fahrenheit). To avoid dehydration, miners drank an average of three liters of water daily. In addition, they had to dodge falling rocks and regularly flee from debris slides. Because of the dangerous work conditions, miners at San Jose? were paid up to 30% more than the competitive wage.15

Buried Alive: The San Jose? Cave-In

Around 2 p.m. on August 5, 2010, a part of the San Jose? mine collapsed, blocking the passage to the tunnels deep within the mine. The miners close to the entrance, although shaken by the deafening thump, emerged unscathed from the mine shortly thereafter. But a group of 33 miners working deeper within the mine were now buried some 700 meters underground with a 700,000-ton rock corked between them and the mine entrance. Trapped deeper than the height of many modern-day landmarks—the Statue of Liberty (93 meters), the Eiffel Tower (324 meters), and the Empire State Building (381 meters)—the miners were blinded by a thick cloud of dust. In spite of falling debris and a slippery tunnel floor (the cave-in had unleashed trapped water between rocks), the 33 miners managed to make their way to a 50-square-meter (540-square-foot) predesignated “refuge” within the mine. No one was critically injured or had broken any bones. The loud cracking sounds inside the mine, however, indicated that the ground was far from stable.16

The First 24 Hours

Luis Urzu?a, the 54-year-old shift foreman, immediately checked provisions in the refuge. He found two oxygen tanks, some expired medicine, and food—1 can of peaches, 1 can of salmon, 2 cans of peas, 4 cans of beans, 20 cans of tuna fish, 96 packets of crackers, 10 liters of water, 16 liters of milk, and 18 liters of juice—which could feed 10 miners for two days.17

Even-keeled and soft-spoken, Urzu?a held formal leadership; in the Chilean mining culture the authority of the shift foreman was considered absolute. But Urzu?a had worked at San Jose? for less than three months and did not know the miners well. Soon arguments caused by fear, frustration, and anger erupted. Many miners had long predicted a cave-in and felt bitter and betrayed. Those with years of experience working at the mine felt frustrated by how little the company had done to safeguard them. One miner in particular, the energetic and charismatic 39-year-old Mario Sepu?lveda, was galvanized. He felt that the miners must take action.18

Along with 63-year-old Mario Go?mez, Sepu?lveda rallied the miners to explore escape routes and send signals to the rescue workers. Sepu?lveda’s appeals resonated with the miners, but most did not follow, staying in subgroups based on kinship and past friendships. Despite the mine’s instability, many ventured out of the refuge, either individually or in small groups. One miner, 27-year-old Richard Villarroel, drove a pickup truck upward through the tunnels until he came across a blockage. He stuffed the edges of the fallen rock with tires and oil filters and ignited them in hopes that the smoke would alert rescue workers. Others ignited dynamite at regular intervals to signal there was life underground. Urzu?a, a topographer by training, stayed back to sketch a map of their surroundings and the mine.19

By the end of their first 24 hours, the miners were exhausted by failed attempts to communicate with the outside world and disoriented by lack of natural light. Most felt accountable to no one. They urinated and defecated wherever they found it convenient. Eventually, subdued by hunger and fatigue, each found spots in the tunnel or trucks and attempted to sleep.20

Search Attempts: The First 24 Hours

Soon after the collapse, rescue personnel from the Chilean Carabineros Special Operations Group (GOPE)—an elite and extremely well-trained police unit—were called. They attempted to reach the miners through ventilation shafts, but continued ground movement rendered these shafts unusable. Meanwhile, as news of the mine cave-in spread through media broadcasts, the San Jose? site quickly became crowded with family members, emergency response teams, rescue workers, and reporters.21

At the time of the collapse, Chilean President Pin?era and the Minister of Mining, Laurence Golborne, were traveling abroad. Pin?era knew that the government needed to get involved. Against the recommendations of his advisers, he asked Golborne and his top aides to go to San Jose?. Legally, San Jose? was a private mine, not under government jurisdiction. Historically, no mining minister had visited the site of a crisis.22 Pin?era recalled his reaction: “There was no possibility for them [the San Esteban company] to respond. The option was thus very simple. The government would assume responsibility for the rescue or nobody would.”23

The Survival Challenge below Ground: Days 2–5

When the miners awoke the next day, 54-year-old Jose? Henri?quez, who had experience preaching, urged everyone to begin their day with a collective prayer. Most heeded the call. After their failed attempts the prior day, many miners wanted to conserve their energy and be patient, but Sepu?lveda disagreed. He urged for engagement as on the previous day. With nothing else to do, the miners started making noise by honking horns, hitting metal on metal, and exploding dynamite. Sepu?lveda and Raul Bustos explored the option of escaping through the ventilation ducts, but many ducts were missing ladders. This option turned out to be nearly fatal when falling rocks barely missed Sepu?lveda as he was rock climbing through one of the ventilation ducts.24

The next day, the miners gathered around Henri?quez to begin the day with a collective prayer. Many started drinking the grimy water from the 15,000-liter water tanks stored for use in mining machinery. It was now day 3, and almost all were aware that they urgently needed to make decisions about the food supply. A democratic process, one vote per each man, was instituted. Having detected no sound of a rescue operation, the miners agreed that no more than a sliver of food every 12 hours should be eaten. Urzu?a and Sepu?lveda would guard the food supplies. This co-guardianship was democratically approved. By the end of the day, permanent sleeping sites were emerging.25

On day 4, the men gathered together for collective prayer. Afterwards, Sepu?lveda urged the group to respect Urzu?a and suggested that if Urzu?a were willing to lead, the miners should accept him as their leader. If Urzu?a were unwilling to lead, Sepu?lveda would be willing to take charge. The miners spent the day performing constructive tasks like building canals to drain accumulated water in their sleeping areas and creating lighting via rigged vehicle batteries. Bathroom rules were established; it was decided that everyone would use empty oil drums for human waste. When full, the waste would be covered with dirt and gravel, poured downstream, and covered with more dirt and gravel. Meanwhile Go?mez, a former merchant marine, shared with others the story of his own 11-day journey aboard a Brazilian cargo ship, where he survived mostly on rainwater.26

The miners soon began to react in distinctive ways. Victor Zamora began to write a diary. Nineteen-year old Jimmy Sa?nchez began to hallucinate. Some began to oversleep and others began to walk through the sloping tunnels, either staring in silence at the boulders around them or cursing them in rage. Many also craved tobacco and alcohol, making it difficult to avoid mood swings.27

On day 5, the miners again began their day with a collective prayer. Sepu?lveda decided to make soup out of a can of tuna and all the miners ate together. Later they spent time searching for escape routes they might have missed in earlier attempts. At 1 p.m., which they decided would become their daily meeting time, each miner’s daily intake was reduced to 100 calories. It was clear that conserving food supply might be critical for survival. Most of the miners were overweight and understood that they could afford to be on a meager intake for a while, despite severe hunger pangs.28

Throughout the day, the miners gave more authority and respect to both Urzu?a and Sepu?lveda; Go?mez was also widely respected for his experience and wisdom. Sepu?lveda had started to assign specific tasks to people based on their skills, experience, and mental stability. The miners also began to use the lighting system to simulate day and night, each lasting 12 hours. When the skin of the miners began to develop mold patches and canker sores due to the heat and humidity, Yonni Barrios volunteered as the group’s medical advisor. Although not a doctor, he had a passion for medicine and was well-read on various illnesses, especially those that his family members had endured.29

Challenges above Ground: Days 2–5

Mining Minister Golborne arrived at San Jose? on August 7, 2010. He found the owners of the mine in shock, overwhelmed by the scale of the accident. “I arrived around 2–3 a.m. at the mine and then I saw the human drama that we had. At that moment, all the families were there . . . there was no trust, there was no information, [and] nobody knew what was going on.”30 He added:

The main problem was with the families. They were really upset, sad, and mainly they didn’t have trust that anybody could help them and they were fearing that the company, [and] the government were lying to them. I had to start trying to establish with them a relationship based on trust and initially trying to avoid the responsibility of the whole operation because according to our legislation, we have no right to interfere in that process. The responsibility is on the shoulders of the company.31

On August 7, Pin?era decided to go to San Jose?. Golborne recalled, “Politically speaking, this was not something advisable to do. My personal opinion I remember when he was traveling to Chile was don’t come here, I mean go directly to Santiago. I will go there [to San Jose?] and keep you informed about what is going on here, but don’t come here because you will get personally involved in this.”32

Nevertheless, Pin?era traveled to San Jose? and met with a small group of family members because “to face 300 or 400 people that were in the middle of such suffering was too complicated,”33 explained Golborne. Pin?era committed the government to putting all its efforts toward the rescue, and Golborne later recalled, “In that moment I felt empowered to take control really.”34 Golborne, who had previously been CEO of Cencosud, Chile’s largest retail chain, explained, “I [was] not knowledgeable in mining . . . what I [did] know [was] how to manage challenging projects, lead people, build teams and provide the necessary resources.”35 Meanwhile, Pin?era turned to the highest executives at the state-run Codelco to provide a technical leader for the search-and-rescue operation.36

Self-Dispatched Responders at San Jose?

As news of the cave-in spread, the Chilean mining community began to mobilize, sending personnel and equipment to San Jose?. Among them was Walter Ve?liz, general manager of geology and in charge of drilling and probing at BHP Escondida. On August 8, Ve?liz had received a call from BHP Escondida’s VP of Safety, Jorge Pino, to report to San Jose? to see what the company could do to help. Ve?liz took Marcos Bermu?dez and Nicola?s Cruz with him for an initial diagnosis. Bermu?dez, a mining engineer and superintendent of drilling and operations at BHP Escondida, had excellent planning skills and a thorough knowledge of drilling. Trained in what he called “adaptive leadership,” Bermu?dez believed in matching technical soundness with clear goal-setting and a strong team. Cruz, a geology expert at Escondida, had over 25 years of experience. He was also trained in negotiations and team management in tough situations such as workers’ strikes.37

Ve?liz, Bermu?dez, and Cruz decided to go to San Jose? with a support staff, drilling machinery, and equipment. They requested three drilling machines, four trucks, a bus, and about 45 support and operating staff members. Upon arrival, they found a disorganized crowd of hundreds of people, but no one seemed to be in charge. They worked through the crowd to talk to the mine’s leadership and found them overwhelmed and without a response strategy.38

As Ve?liz, Cruz, and Bermu?dez looked for familiar faces, they saw Jose? Toro, a geologist from Codelco. Toro was speaking with the mine’s geologists. Ve?liz, Cruz, and Bermu?dez joined these conversations and learned that a massive rock, twice as hard as granite, had blocked the mine entrance, just as a cork would seal a bottle. They thought that if the miners followed the emergency protocol they would be at the refuge, 700 meters underground. By drilling a small borehole, 15 centimeters in diameter, they could transport oxygen and food to the miners. Because oxygen- and food-supply holes might eventually be needed to sustain the miners till they were rescued, the men decided to begin drilling. They obtained outdated tunnel maps and a rough drilling plan from the mine leadership. Six drilling spots were identified, and the site soon filled with drilling equipment. With inaccurate maps of the circuitous tunnels swirling underground, drilling would be an inexact science.39

Breaking New Ground: Technical Challenges

The depth of the refuge was discouraging. Available drills had a precision of about 5%, which meant that at a depth of 700 meters, the drill could hit anywhere in a base area of 3,850 square meters. As the refuge was only 50 square meters, the chance that any given drill hole would hit the refuge was just over 1 in 80—and that assumed accurate targeting at the center of the refuge when drilling began at the surface (see Exhibit 3). The poorly mapped, snake-like tunnels inside the mine complicated matters further. Additionally, drillers had to set their equipment off to the side and drill at an angle to avoid pressure on the mine head.40

While early drilling attempts failed to locate the miners, they revealed some features of the mine and the fallen rock that were not obvious. The fallen rock trapped water and sediments, increasing drill deviations and further hampering drill precision. Moreover, in routine drilling operations, precision was measured after a hole was completely drilled. Here, measurements would have to be made every few hours to promptly discard holes that deviated too much.41

Managing the Search Effort: Strategic Challenges

When Pin?era contacted Codelco, executives selected Andre? Sougarret to lead the rescue. Known for his calm temper and composure, 46-year-old Sougarret was an engineer with over 20 years of experience in mining, an underground mine specialist, and a manager at Codelco’s El Teniente mine. With over 2,400 kilometers of tunnels and a 15,000-person workforce, El-Teniente was the world’s largest underground mine. “Andre? has remarkable technical competence and is a man with a strategic view. He has a lot of patience, assertiveness, an exceptional ability to listen and reach conclusions after listening to all sides, and a tendency to speak frankly with everyone whether they are above or below his authority,” explained Ricardo Alvarez, a senior Codelco executive who recommended Sougarret to lead in the crisis.42

Alvarez, who had worked for over a decade to develop a teamwork culture among Codelco employees, put together a support team for Sougarret. “We wanted to send Andre? with as much support in the beginning, which, if not needed, we could pull back. But we didn’t want him to get there and waste time calling us for more support,” noted Alvarez. Sougarret was supported by 32 people from Codelco, including staff for food and camp provisions, two highly experienced mine superintendents, a communications expert to guide interactions with the media, and Rene? Aguilar, a psychologist known for his stellar communication skills, who had over 10 years of experience in risk and human resource management in the mining industry.43

On the morning of August 9, Sougarret was asked to come to La Moneda, the presidential palace in Santiago. After a 90-minute car drive from his home to La Moneda, Sougarret was escorted to the airport, where he boarded the presidential jet to San Jose?. During the flight, Pin?era asked Sougarret to develop a plan to rescue the miners and gave him his full support. At San Jose?, Pin?era introduced Sougarret to the families and press as the leader of the operation.44

Sougarret first met with his support team from Codelco. Sougarret, Aguilar, and the Codelco mine superintendents knew each other well and had undergone leadership and team-building training together over the course of many years. They decided that Aguilar would oversee the nontechnical aspects of the operation while Sougarret would focus on the technical aspects. To learn more about the situation, Sougarret and Aguilar conversed with mine owners and workers, experts, and heads of the drilling companies on-site and concluded that, given the resources at the refuge, the miners could survive up to a month. They also observed that the simultaneous drilling efforts lacked a coordinated strategy. To clear the drilling site, they established a drilling perimeter within which only people with technical expertise were allowed.45

Organizing Search Efforts

Sougarret had intended to work through the mine tunnels, but the mine’s instability rendered this option unviable. Even though it was not his expertise, he concluded that drilling would have to be the key approach and decided to focus on coordinating the drilling efforts; he thought some efforts could be faster but less accurate, while others could be relatively slower, with more room for course correction, yielding an overall balanced portfolio of search efforts.46

Noticing Ve?liz’s credibility on-site, Sougarret appointed him in charge of all drilling efforts. Ve?liz now had direct access to Sougarret and full authority over the drilling operations. Ve?liz put Cruz in charge of drilling operations and data analysis. He put Bermu?dez in charge of ground operations, logistics, and maintaining collaboration among the workers. In turn, Bermu?dez engaged in what he described as “consultative leadership,” in which he explained the rationale of every decision to his workers to promote buy-in and input during execution. Bermu?dez was given direct access to Pin?era’s aides, who could expedite delivery of needed resources. “The support we received regarding the tools we needed [spare parts, drill bits] would normally take a few days to arrive, but here the response time was very short—same day in some cases or even just hours,” Bermu?dez recalled.47

Bermu?dez, Cruz, and Ve?liz planned a daily routine: to meet for half an hour every morning and call for a quick meeting whenever necessary. They developed a protocol for transitioning between day and night drill shifts and for routine maintenance of machinery. “The team generated a working structure, which was presented and shared with the larger group and was finally the way we were organized. We worked as a team, that is, we consulted and shared the strategy and, based on this, we defined and made all important decisions,” said Bermu?dez.48

Managing External Communication

Golborne assigned Aguilar to communicate regularly with the families.49 Aguilar also had to protect the search team from media exposure. “We wanted them [drillers, engineers, and geologists] to drill and work without any noise and distractions,” noted Aguilar. To keep press and family aware of progress, Sougarret and Aguilar held two separate briefings every day to avoid mixing both parties’ concerns. The first meeting was with families at 10 a.m., the second with the press at noon. Critical, in their view, was a consistent message. Aguilar knew families and press would communicate, and mixed messages could “very quickly damage people’s trust in us.”50 Golborne explained, “The decision of transparency was a conscious decision made early on. There were too many people, we could not hide anything . . . If we did, we would lose their confidence.”51

In initial meetings, Sougarret and Aguilar established the daily communication schedule and outlined their respective roles, expertise, intentions, and commitment to the operation. “We told them, we are workers in a mine too and dedicated 100% to bringing your families and loved ones home,” recalled Aguilar. But they were also realistic. He added, “The facts are what they are, and in a situation like this you really have to be patient and explain to people what is happening, what the problem is, what solutions we are thinking about, and why they are good. You cannot ignore people’s concerns and emotions, but you have to tell the truth in an understanding way to earn their trust.”52 But maintaining an honest tone met with continuous pressure. Golborne noted, “Every day I had to deal with people saying that we were doing the wrong thing . . . Now it is a little funny, but a mentalist was telling us about a guy with broken legs at the entrance of the mine asking to be rescued . . . [and] you have to manage all kinds of pressures.”53

Managing Internal Communication

Sougarret briefed Golborne every day by email and once every three days in person. He also had a direct line to Pin?era, who wanted regular updates and was ready to mobilize his network as needed. With search teams on-site, Sougarret and Aguilar developed an operating routine. Daily at 9 a.m. there was a coordination meeting with the heads of all drilling and geology teams; they reviewed commitments made the day before, discussed next steps, and identified resources needed by the drilling team. After the coordination meeting and daily briefing with the families and press, Sougarret and Aguilar spent time in the field, listening to concerns, asking questions, and answering queries.54

Golborne and Sougarret worked together to create collaboration and openness on the search team. Sougarret recalled, “There was no super leader who had all the answers . . . I liked the honesty with which we were working . . . I could feel we were playing with our cards open on the table.”55 Without micromanaging, Golborne asked numerous questions to probe the rationale behind technical actions: “I did what I normally do, let the experts talk.”56 He also served as an arbiter on unresolved issues.57

Sougarret and Aguilar communicated many times a day, including every morning before the coordination meeting and every evening. These conversations included frequent discussion of values. “Values are really important in a situation like this. For me, I was there to save the miners and be of help to others,” said Sougarret. Aguilar noted, “Andre? [Sougarret] and I talked a lot about our values . . . All we wanted to do was save the miners and help in whatever way we can . . . That was our job, to help. If your values are clear, then it is easier to stay focused.” All involved in the drill efforts appeared impressed by the leadership of Golborne, Sougarret, and Aguilar. They liked, respected, and trusted them, and felt that they kept everyone highly focused on saving the miners.58

Managing Stress, Anxiety, and Blame

Aguilar sought to inspire collaboration among drilling companies that were usually competitors. As he recalled, “It was important from day one to keep reminding everyone that we are here for one purpose only—rescue [the] trapped miners as soon as possible. We don’t have time for fighting, competing, and blaming because you are risking lives by doing that.” Aguilar regularly checked “how people were emotionally coping with the situation,” as he later put it. He emphasized that “this was a pressure environment, and when someone looked low and frustrated we would try to ask each other, hey, are you okay? Is your family okay? Why don’t you take some rest? These are small things, but they help create a sense that we are there for each other.”59

Sougarret and Aguilar welcomed input from San Jose? mine employees. “They knew the site well, offered their support by moving trucks or recalling tunnel layouts, and we welcomed them because no one had all the information, but everyone knew something that could save the miners,” recalled Aguilar. The press continued to raise questions about reprimanding the mine owners, but Golborne urged them to focus on finding the miners; sorting out the causes of the cave-in could wait.60

Below Ground: Days 6–13

On August 10, a coordinated drilling effort commenced, sending a surge of hope to family members camping nearby in what would later be called Campo Esperanza (or Camp Hope). The sound of drilling led to an eruption of joy and hope underground.. However, two miners were aware of the imprecision of this kind of drilling and recognized that it would take a near miracle to accurately drill through such hard rock and such depth. Their initial jubilation soon became clouded by doubt and fear.61

As the drill sound remained distant, on day 9 the miners voted to reduce food rations to one meal every 36 hours. Having lost a lot of weight, they nevertheless understood the need to continue with minimum caloric intake. As the days wore on, they began to discuss what awaited them if rescued. Franklin Lobos, a former soccer star in Chile, shared his dreams of opening a nonprofit foundation to improve the conditions of workers. Ariel Ticona anticipated the upcoming birth of a child. Twenty- five of the miners lived very close to the San Jose? mine and had many stories in common. As the miners shared their stories and expectations, they decided to name themselves “the 33 Musketeers.”62

With the approaching drill sound as a backdrop and continuous hunger pangs in the foreground, the miners wrote letters and notes to loved ones. They developed a protocol in case of a drill breakthrough: they would use a bulldozer to clear debris from the drilling, they would paint the drill shaft with orange spray paint, and they would attach their letters to the drill tip.63

Above Ground Search Operations: Days 6–14

The drills worked around the clock, stopping daily at 8 a.m. and 8 p.m. for maintenance. Sougarret and Aguilar continued to coordinate the drilling teams. They frequently reminded the teams of their common purpose: finding and rescuing the miners. When extra drilling parts and equipment were needed, Sougarret listened to the rationale for the request and placed expedited orders. The relationship between Sougarret and Ve?liz strengthened as Sougarret provided strategic oversight and Ve?liz (along with Cruz and Bermu?dez) took charge of the technical details of the drilling efforts.64

A New Technology for Measurement

On August 11, Fe?lipe Matthews, a geologist with experience as a manager for drilling operations, arrived at the site. Four years earlier, he had founded a company, Geoatacama, to commercialize a technology for measuring drilling trajectories with greater precision. A gyroscope-like probe was inserted into a drilling hole and, regardless of the position of the mounted drill, the probe could find the vertical by virtue of the angular momentum of its spinning mass. The technology was simple but not commonly used in mining. Matthews recalled, “I knew I had something unique to offer because drillers are not geologists and geologists cannot drill. I could work with both, and I also had this new technology to measure perforation trajectory that was more precise than mainstream technology.”65

After the cave-in, Matthews reached out to Ve?liz and Cruz, who had attended the same university he did. The use of Matthews’s technology was quickly approved by Sougarret, after input from Ve?liz and Cruz. However, when Matthews made measurements on drill holes, they were inconsistent with those from the other companies on-site. Cruz called for an accuracy test: one person from each company was to go to an abandoned pipe on-site and measure its profile. A high-precision GPS was then used to measure the profile of the pipe. Matthews’s equipment was found to be the most accurate. Thereafter, he was put in charge of measuring the accuracy of all drilling profiles.66

Planning Ahead

Parallel to drilling attempts, rescue plans were developed. Pin?era had publicly declared that the trapped miners were to be rescued dead or alive; if dead, the bodies of the miners would be recovered and returned to their families for proper burial. Additionally, Pin?era requested the development of multiple rescue options. To do so, an off-site team of consultants was formed. Fernando Silva, an independent consultant on this team, commented, “In the beginning we didn’t know if the miners were alive. . . . But Pin?era communicated with us and also publicly announced that we would rescue the miners, dead or alive. This gave us a green signal to fully commit and develop rescue plans.”67

Operating 500 kilometers from San Jose? at the Codelco headquarters in Santiago, the off-site team included people with vast experience in mining, deep knowledge of the latest mining technologies, and risk management experience. For instance, Silva had over 20 years of experience in drilling design, construction, and operations, and was also an expert on fire protection safety code. Members of the off-site team conducted follow-up conversations with the local and international companies that sent rescue proposals to Chile’s Ministry of Mining website. They evaluated each proposal on criteria such as availability, cost, service schedule, maintenance and logistics, and state of the technology (in particular, if it had been used in Chile and was viable for these conditions). These evaluations were discussed with Golborne.68 Silva noted:

We did a lot of conceptual work for the rescue away from the site. We studied a lot of options. For example, there was a mine nearby and there was a suggestion that a two- kilometer tunnel could be made in 16 months. We said no to that option because it was too slow. We said no to building a ramp because that would take 14 months. Saying no to options was not hard. It was harder to propose a workable alternative.69

Meanwhile, Sougarret and Aguilar anticipated the future needs of the rescue operation by requesting research assistance on specific subjects, either calling on the off-site consulting team or government aides. For instance, they requested research on the type of piping to be used to establish communication lines with the refuge and to lower cameras to scan the space. They explored the use of exploratory robots with attached cameras in case the initial lowering of cameras did not show any signs of miners. Another expert contacted was Miguel Fortt, a physics professor at Universidad del Mar in Chile and a former miner with extensive experience in rescue efforts for mining accidents. He suggested that the miners could be reached via a series of PVC piping tubes. This piping could be used to deliver food and water until the miners were rescued. Testing on this plan began shortly thereafter.70 Aguilar recalled, “We planned and thought through as many scenarios as we could, and in meetings for every scenario we asked questions about, okay, tell me, what is the best, acceptable, and most negative outcome, and if it happens how will we respond?”71

Going 3-D with Drill Profiles

Meanwhile, Marcelo Arancibia, VP for South America at Maptek, an Australian software company, volunteered his company’s 3-D mapping technology. Ve?liz and Cruz decided that Maptek’s software would help in visualizing drill profiles; if the probe from Matthews’s device was connected to Maptek’s 3-D plotting software, the trajectory of a given drill hole could be graphed and the visual image produced could provide drillers with real-time feedback.72

Sandra Jara, a geologist from Maptek, was sent to San Jose? to assist. Matthews brought drill profile measurements to Jara, who made a visual profile of each drilling effort and showed it to the drilling supervisor and operator. If a profile had deviated, the team discussed course correction strategies. This approach was a radical departure from usual practices, as Matthews explained:

Under routine procedures, drilling accuracy is evaluated after the perforation is done and trajectory is measured. If the perforation is within the limits defined in the contract, the drilling company gets paid for its service. If there are differences, the drilling company can incur fines that could even lead to no pay whatsoever. The concept applied in this occasion—that is, to measure the perforation at regular intervals in order to make corrections—is very different from how drillers usually work.73

This new process of continuous feedback on the drill profiles was beneficial but frustrating, as it brought frequent bad news about failed attempts. Meanwhile, the top leadership continued to emphasize the need for speed along with accuracy. Golborne came to the work site regularly to remind everyone of the scenario in which they would reach the refuge but not fast enough to matter. Drillers felt that Golborne’s presence demonstrated the government’s commitment to the rescue and helped them stay focused and acutely mindful of the time pressure and importance of their task.74

Searching for Patterns in Drill Profile Data

Drillers knew that deviations during drilling depended on the rotational speed and weight of the drill: increasing rotational speed shifted the profile to the right, while the weight of the drill bars altered the vertical profile. The drill profile data collected thus far helped clarify the extent of drill shift and the role of speed and weight in the shifts. Examining the data, Cruz had an epiphany: “If we are to reach the refuge we will have to start drilling in a direction quite different from the refuge because there was an inevitable curve to every drill effort. It is like making a soccer goal at an angle where the curvature eventually brings the ball to the net.” Initially Cruz’s suggestion to drill in a direction away from the refuge seemed counterproductive to others. The metaphor of a soccer goal helped, as did Cruz’s patience and clarity in explaining his conclusions. The drillers followed Cruz’s strategy, and on day 14 one of the drills passed the 600-meter mark and seemed on course to the refuge. Anticipation and hope buoyed everyone above ground.75

Below Ground: Days 14–16

The trapped miners awaited the long-anticipated drill breakthrough. Their reaction protocol was well rehearsed, and with excitement, they followed the sound of the approaching drill. With dawning fear, they realized the drill had passed the lowest tunnel and continued onward, stopping below them. The miners fell silent as the shock and the implications sank in. They had hoped, prayed, and prepared for this day, working through hunger and painful letter-writing to loved ones. Finally, one of the miners, Edison Pen?a, screamed in despair. Most did not know what to do next. To give up? To hope for another drill attempt? Henri?quez urged all to maintain their faith and pray. The miners would recall this as their darkest hour as they hoped in vain through the unbearable confinement. Many miners began to write good-bye letters. The following day, with barely any food left, cannibalism began to loom as an inevitable option; the men voted to lower rations to one bite of food every three days. With barely any strength left even to go to the bathroom, most just laid down.76

Above Ground: Another Setback

The miss was a major setback. Local newspapers included headlines such as “El guatazo de los te?cnicos,” or “the technicians screw up.”77 A deeply disappointed Sougarret communicated the news to families who now pleaded that the local miners be allowed to pickax through the mine entrance. Sougarret advised government officials not to approve such efforts as they may cause another accident. Pin?era considered approving these actions if they posed no clear harm, but Sougarret spoke with Pin?era and Golborne directly against this option until they conceded. Family members protested and police officers were deployed to control the crowd. “It was an extremely difficult position for me, and I will never forget when people said, ‘imagine your own loved ones trapped.’ It was one of the toughest decisions for me and emotionally very difficult,” reflected Sougarret.78

Day 17

By day 17, many of the miners felt they could not survive much longer. They heard another drill approach but did not dare to hope again. The drillers had learned more about the tunnel layout from their past failed attempt and were hopeful that a breakthrough could be made by 6 a.m. This hole was being drilled at a faster speed (around 240 meters per day), but it was difficult to correct its course in case of deviations. At 5:50 a.m. the drill broke through a tunnel near the refuge.79

The miners were, at first, silent in disbelief and then overcome with joy. They quickly gathered a can of spray paint and began tapping on the drill shaft. Sougarret used a stethoscope to try to amplify any tapping from trapped miners and thought he sensed signs of life. After about an hour of tapping back and forth, Eduardo Hurtado, the drill operator, began the tortuous, three-hour task of retracting the 700-meter, 20-metric-ton metallic drill shaft. Upon its retrieval, the shaft was marked with orange spray paint and carried many handwritten notes, one of which famously read, “Esta?mos bien en el refugio, los 33” (“We are fine in the shelter, the 33 of us”).80

Pin?era arrived at the San Jose? site by noon. As he made an official announcement, jubilation erupted, and for hours people at Camp Hope hugged one another, cried, laughed, waved the Chilean flag, and honked their car horns. The international media was stunned.81

The search workers had finally finished their determined race against time. Now Sougarret and Aguilar tried to focus them on the rescue options. Nothing was certain yet. Food, water, medical care, communications, and much more was needed to be transported through the breakthrough shaft.82 The miners had been reached, but not rescued. The team had achieved a breakthrough, but the crisis was far from over. Golborne recalled, “17 days of only frustration . . . That frustration was finally over . . . After that we saw the light at the end of the tunnel. Time was of the essence.”83[supanova_question]
