Case Summary Document Format:

The recommended methodology will be IRAC, i.e. Issue (basis of the case), Response (of the parties in the case/Relevance/Recommendations (of the student), Application (to the issue or problem raised and the different options out there) and Conclusion (Analysis of the company’s response and well as your recommendations Thus, to expand on the above , the IRAC categories are the main “headings” of your written case summary and under the “IRAC” categories are sub-headings that may take the following forms, e.g. Basis of the case/Pertinent issues (Issue), Analysis of the fact pattern in the case (Response), alternative options prescribed (Application), Predicted, Possible, and Desired Outcomes (Conclusion) etc. must be part of the case summary.

Case Presentation Format:

As the occasion arises, the student team will then prepare an analysis of the case, the issues arising, the alternative options, and their recommendations, all at the same time defending their positions. The presentation can be a PowerPoint presentation.

For this assignment you will write a 3-page analytic “commentary” on the ethical case we read and discussed in class. A thoughtful response includes a careful analysis of the problem (what makes it a dilemma? What values and principles are at stake?) and developing your own response to the problem, supported by arguments and relevant evidence from the case. Here, you should expect to draw on what you learned from the readings and class discussion, and to support your reasoning with relevant facts of the case study and perspectives from the commentaries that support your points.

As part of your commentary, please address the following three dimensions:

1.Analyzing the central problem and the values at stake. What is the central dilemma in this case? Why is this a dilemma? What values or principles are at stake? Is there disagreement about these values? Do they compete in some way? What practical and/or policy considerations are at stake? Is there disagreement about these? Do they compete in some way?

2. Formulating possible responses, choices, actions. What the reasonable choices or lines of action might be available, and to whom? How does each of these choices frame and address the issues at stake? For each choice, what is gained and what is lost? Who should take action (or not)? What should they do? Why?

3. What have you learned from this case that might apply elsewhere? What are the broader lessons that we might take from this case for how you understand educational policies or practices? Issues of educational equity and fairness? Other principles or values that might guide the practice of teaching or the organization of schools?

This is a multi-part assignment. You must reply to all required elements by the due date to have the potential to earn full credit.

1. Drawing on the material presented in your Open to Debatee-text and the corresponding power point lecture outlines and lectures or video lecture clips, explain, why judges, who are not popularly elected, have such wide authority to strike down popular laws; why do judges have such enormous power with so little public accountability? Why does the U.S. have such an undemocratic institution in its democracy?

Drawing on Saffell, Meese, and Brennan in ch. 13 of your American Government: Examinedreader (you may also find the material presented in the Judiciary chapter of your Open to Debate e-text and the corresponding power point lecture outline and lectures or video lecture clips to be helpful), do you think Justices should act according to the dictums of judicial activism or judicial restraint? You will want to include direct references to Meese and Brennan in your response.
3. Pretend you are a Supreme Court Justice who must render a decision in the three LGBT cases currently before the Supreme Court: Altitude Express v. Zarda, Bostock v. Clayton County, and Harris Funeral Home v. EEOC. I want you to act as a S.C. Justice and, drawing on what you have already in this assignment, the U.S. Constitution, and other relevant course materials, render a decision. How would you rule? Why? On what are you basing your decision? Which parts of the Constitution or other documents are relevant? Remember you are acting as a justice, not simply expressing your personal opinions.
